La direction des Affaires juridiques est saisie des questions juridiques et des projets de lois. Elle assiste et conseille les services d’administration centrale et déconcentrés dans son domaine de compétence. Elle traite les contentieux au sein du ministère.
Elle comprend, outre le pôle ressources et greffe et la mission publication et ingénierie normative :
- la sous-direction des affaires juridiques de l’administration générale ;
- la sous-direction des affaires juridiques de l’environnement et de l’urbanisme ;
- la sous-direction des affaires juridiques de l’énergie et des transports.
Le directeur des affaires juridiques est assisté d’un adjoint, chef de service et d’un directeur de projet (production normative).
La sous-direction des affaires juridiques de l'administration générale
La sous-direction des affaires juridiques de l’administration générale est saisie des questions juridiques et des projets de lois et de décrets relatifs à l’administration générale et à l’organisation des services, aux marchés publics, au droit pénal et à la procédure pénale, au droit privé et au droit des technologies de l’information.
Elle assiste les services pour toutes les questions relatives aux obligations des fonctionnaires et au droit disciplinaire. Elle assure la protection pénale des agents et traite de toutes les questions relatives au droit pénal. Elle assure la promotion des règles déontologiques.
Elle assure, par des actions de conseil et d’assistance aux services, la qualité, la sécurité et la régularité de la commande publique du ministère.
Elle conseille les services en matière de contentieux général. Elle est chargée des contentieux à caractère institutionnel, du contentieux de la fonction publique et du contentieux relatif à l’ingénierie publique.
Elle assure le traitement des contentieux judiciaires en liaison avec l’agent judiciaire du Trésor et traite les accidents de la circulation relevant de la loi n° 85-677 du 5 juillet 1985 pour l’ensemble de l’administration.
Elle apporte son concours à la coordination du suivi de la transposition des directives et du programme de travail législatif et réglementaire.
Elle comprend :
- le bureau du droit pénal, du droit privé et de la déontologie
- le bureau du droit de la commande publique
- le bureau du droit des statuts et des organisations et de la législation générale ;
- le bureau du conseil et du contentieux administratif général.
La sous-direction des affaires juridiques de l’environnement et de l’urbanisme
La sous-direction des affaires juridiques de l'environnement et de l'urbanisme est saisie des questions juridiques et des projets de lois et de décrets relatifs à l'environnement et à l'urbanisme. A ce titre, elle est associée par les directions concernées et notamment la direction des affaires européennes et internationales (SG/DAEI) à la préparation, à l'élaboration, aux procédures de ratification et à la mise en œuvre des conventions internationales en matière d'environnement et de développement durable. En liaison avec les autres directions du ministère, elle coordonne la transposition des textes communautaires en matière environnementale ; elle assure le suivi des pré-contentieux et contentieux communautaires dans les domaines de l'environnement et de l'urbanisme. Elle apporte son expertise sur les modalités d'insertion des nouvelles dispositions législatives ou réglementaires dans le code de l'environnement.
Elle conseille les services centraux et déconcentrés sur l'application des dispositions relatives à la police de l'environnement. Elle traite le contentieux du ministère en matière d'environnement et d'urbanisme. Elle assure une mission de veille juridique dans ses domaines de compétence.
Elle comprend :
- le bureau des affaires juridiques de l'urbanisme
- le bureau du droit général, du droit pénal et du droit européen et international de l’environnement
- le bureau des affaires juridiques de l'eau et de la nature
- le bureau des affaires juridiques des risques pour l'environnement.
La sous-direction des affaires juridiques de l’énergie et des transports
La sous-direction des affaires juridiques de l’énergie et des transports est saisie des questions juridiques et des projets de lois et décrets relatifs aux infrastructures, aux transports et à l'énergie dans le cadre du domaine de compétence du ministère. Elle traite le contentieux du ministère en ces matières.
Elle comprend :
- la mission de codification du code des transports
- le bureau des affaires juridiques de la mer
- le bureau des affaires juridiques des infrastructures et de l’accessibilité des transports
- le bureau du droit général des transports, de la domanialité publique et de la législation économique
- le bureau des affaires juridiques de l'énergie
Le pôle ressources et greffe et la mission publication et ingénierie normatives sont rattachées au directeur.
Le pôle ressources et greffe coordonne le suivi général des dossiers en cours, en particulier les dossiers contentieux, assure l’administration du système d’information juridique. Il traite les questions communes intéressant les moyens de la direction ;
La mission publication et ingénierie normative est chargée de l’édition du bulletin officiel. Elle assure la fonction d’administrateur du système d’organisation en ligne des opérations normatives (SOLON) et contribue à la simplification et à la qualité des formulaires utilisés par le ministère.
Tout comme l’ensemble du Secrétariat général dont elle fait partie, la DAJ est créée en 2008 lors de la fusion des ministères chargés de l’Équipement et de l’Environnement. Elle a été organisée par la fusion d’anciens bureaux chargés des Affaires juridiques de ces ministères. En effet, avant 2008, chaque direction possédait une cellule chargée des Affaires juridiques qui ont été regroupés en sous-directions thématiques de l’actuelle DAJ afin de centraliser cette fonction au sein du Secrétariat général. Elle est donc conçue en trois sous-directions reprenant les thématiques de l’administration générale, l’environnement et l’urbanisme, l’énergie et le transport. Ces thèmes sont ceux qu’abordaient les anciens ministères.
La sous-direction des Affaires juridiques de l’Administration centrale (AJAG) est constituée de quatre bureaux issus de l’ancien ministère de la direction des affaires financières et de l’administration générale du ministère de l’équipement.
La sous-direction des Affaires juridiques de l’Environnement et de l’Urbanisme (AJEU) est constituée d’un ancien bureau du ministère de l’équipement (le bureau du contentieux de l’urbanisme DGUHC/AU/DU/2 est devenu le bureau des affaires juridiques de l’urbanisme SG/DAJ/AJEU/1) et de trois bureaux issus de l’ancien ministère de l’environnement (bureau de la législation et du contentieux, bureau du droit communautaire et international et bureau du droit de l’environnement et du droit pénal).
La sous-direction des Affaires juridiques de l’Énergie et des Transports (AJET) est constituée d’un ancien bureau de la direction des affaires maritimes du ministère de l’équipement, d’un bureau de l’ancienne direction des routes, d’un bureau pour partie issu de la direction des affaires financières et de l’administration générale du ministère de l’équipement et d’un bureau créé ex nihilo (bureau des affaires juridiques de l’énergie) lors de la création de la direction des affaires juridiques, auxquels d’adjoint la mission de codification du code des transports auparavant située au sein du ministère de l’équipement.
Le PRG est constitué de l’ancien Pôle Ressources de la sous-direction des affaires juridiques du ministère de l’environnement.
