France. Autorité de régulation de la distribution de la presse (2011-2019)
Le collège de l’ARDP est composé de quatre membres désignés par arrêté du ministre chargé de la communication, sur proposition du vice-président du Conseil d’Etat, du premier président de la Cour de cassation, du premier président de la Cour des comptes et de l’Autorité de la concurrence. Le mandat, non révocable pour les membres, est de quatre ans, renouvelable une fois. Le collège est renouvelé par moitié tous les deux ans.
Le président de l’Autorité est désigné parmi les membres, par décret du Président de la République. Il est l’ordonnateur secondaire des dépenses de l’Autorité et a qualité pour agir en justice.
Les services de l’ARDP se composent d’un secrétaire général, nommé par le président de l’Autorité, et d’une assistante. Des rapporteurs peuvent également être nommés de la même façon.
Présentation
L’Autorité de régulation de la distribution de la presse (ARDP) est une autorité administrative indépendante (AAI), pourvue d’un collège de quatre membres (dont un président) et d’un secrétaire général, qui exercent tous leurs fonctions en complément de leur activité principale.
L’ARDP est chargée de surveiller le système de distribution de la presse et son réseau, en veillant à sa liberté et à son impartialité, à son bon fonctionnement ainsi qu’au respect des règles de la concurrence.
Historique
Depuis la loi du 2 avril 1947 relative au statut des entreprises de groupage et de distribution des journaux et publications périodiques, dite loi Bichet, la régulation du système de distribution de la presse était assurée par le Conseil supérieur des messageries de presse (CSMP). Personne morale de droit privé, chargé d’une mission de service public, le CSMP doit veiller au pluralisme de la presse en garantissant l'impartialité de sa distribution.
2011
Afin de renforcer la régulation de ce secteur d’activité, fragilisé depuis la fin des années 1990 par l’apparition du numérique, la loi du 20 juillet 2011 relative à la régulation du système de distribution de la presse a créé l’Autorité de régulation de la distribution de la presse (ARDP).
Elle était chargée, d’une part, d’arbitrer les différends relatifs au fonctionnement des sociétés coopératives et commerciales de messageries de presse, à l'organisation et au fonctionnement du réseau de distribution de la presse et à l'exécution des contrats des agents de la vente de presse et, d’autre part, de rendre exécutoires les décisions de portée générale prises par le Conseil supérieur des messageries de presse.
L’ARDP était à l’origine un organisme financé par des contributions des acteurs privés de la filière presse et chargé d’une mission de service public ; l’agent en charge du secrétariat permanent exerçait les mêmes fonctions au sein du CSMP.
2015
Pour garantir l’indépendance de ses décisions, la loi du 17 avril 2015 portant diverses dispositions tendant à la modernisation du secteur de la presse a qualifié l’ARDP d’autorité administrative indépendante, comme l’a relevé le Conseil constitutionnel. Elle a également confié à l’ARDP le soin d’homologuer les barèmes des tarifs des sociétés coopératives de messageries de presse.
2019
La loi du 18 octobre 2019 relative à la modernisation de la distribution de la presse supprime l’Autorité de régulation et transfère ses attributions à l’ARCEP, qui prend à cette occasion le nom d’Autorité de régulation des communications électroniques, des postes et de la distribution de la presse.
Missions
Les missions de l’ARDP sont définies par la loi du 20 juillet 2011 : « L'Autorité de régulation de la distribution de la presse […] et le Conseil supérieur des messageries de presse […] assurent, chacun dans son domaine de compétence, le bon fonctionnement du système coopératif de distribution de la presse et de son réseau et prennent toute mesure d'intérêt général en matière de distribution de la presse, dans les conditions définies par la présente loi. Ils veillent au respect de la concurrence et des principes de liberté et d'impartialité de la distribution et sont garants du respect du principe de solidarité coopérative et des équilibres économiques du système collectif de distribution de la presse. »
L’ARDP a un rôle de régulation qui se traduit par les quatre types de décisions suivantes :
l’attribution du caractère exécutoire aux décisions de portée générales prises par le Conseil supérieur des messageries de presse dans le cadre de sa mission générale visant à assurer le bon fonctionnement du système coopératif de distribution de la presse et de son réseau,
l'homologation des barèmes des sociétés coopératives des messageries de presse,
la reconnaissance d’un accord mettant fin à un différend relatif aux activités de distribution de la presse,
le règlement des différends n’ayant pu faire l’objet d’une conciliation devant le Conseil supérieur des messageries de presse, à la demande d’une partie ou du président du Conseil.
L’ARDP formule, chaque année, deux avis : le premier sur l’exécution par le CSMP de ses missions de supervision des sociétés coopératives de messageries de presse ; le deuxième sur l’évolution des conditions tarifaires des sociétés coopératives de messageries de presse, après consultation du CSMP.
L’ARDP peut être saisie par l’Autorité de la concurrence de toute question entrant dans le champ de ses compétences, ainsi que de toute question relative au secteur de la distribution de la presse. L’ARDP dispose elle-même de pouvoirs de saisine, de substitution et d’action en justice.
