Plusieurs organes participent au fonctionnement du CNV :
un conseil d'administration, dont le président est nommé par décret après consultation des organisations professionnelles et composé de 26 membres (puis 32 membres avec les modifications apportées par le décret n° 2008-140 du 13 février 2008). Il délibère sur les grandes questions intéressant le fonctionnement du CNV : programme d'activités, budget, compte financier, règlement intérieur. Il est également chargé d'approuver toutes les propositions d'aides formulées par les commissions spécialisées.
quatre commissions spécialisées, composées de professionnels, de membres nommés par le ministère de la Culture et d'un représentant de la SACEM, examinent les dossiers dans le cadre de programmes définis au règlement intérieur :
- contrôle des comptes entrepreneurs (commission n° 1)
- promotion et développement économique (commission n° 2)
- aide à la promotion d'artistes et à la création de spectacles (commission n° 3)
- salles de spectacles et équipement (commission n° 4)
un comité des programmes, composé des présidents des commissions et des représentants du ministère de la Culture, assure un lien entre le conseil d'administration et les commissions, veille à la cohérence des actions et évalue la pertinence et d'efficacité des programmes.
un conseil d'orientation, placé auprès du président du CNV, émet des avis sur l'ensemble de l'activité du centre et évalue l'accomplissement de ses différentes missions. Il est notamment saisi, pour avis, sur le rapport annuel d'activité.
Créé par l'article 30 de la loi n° 2002-5 du 4 janvier 2002, le Centre National de la Chanson, des Variétés et du Jazz (CNV), établissement public industriel et commercial (EPIC), placé sous la tutelle du ministère de la Culture, a remplacé l'Association pour le Soutien de la Chanson, des Variétés et du Jazz (ASCVJ), fondée en 1986, et communément nommée Fonds de Soutien.
Le décret n° 2002-569 du 23 avril 2002 précise les modalités d'action de cet établissement qui remplit trois grandes missions :
le soutien, grâce aux fonds collectés par la taxe sur les spectacles de variétés (ancienne taxe parafiscale sur les spectacles), des entreprises de spectacles par des subventions, aides financières et mesures de soutien économique accordées aux entreprises de spectacles, pour la création, la production, la diffusion et la promotion de spectacles de variétés ; aux entreprises, organismes ou groupements poursuivant des objectifs d'intérêt général en faveur du spectacle de variétés ; aux entreprises, maîtres d'ouvrage, propriétaires ou exploitants, pour l'implantation, la réhabilitation, l'aménagement et l'équipement de salles de spectacles ainsi que la coordination du programme des salles "Zénith" en région.
le développement des activités commerciales dans l'intérêt collectif de la profession, en vue d'améliorer l'environnement économique du secteur de la chanson, des variétés et du jazz grâce à la réalisation, la diffusion et la commercialisation d’exploitation de réseaux d’affichage et de promotion (notamment des publications, y compris sur support informatique).
la mise en oeuvre d'un centre de ressources sur l'environnement artistique, économique, social, technique et patrimonial du spectacle vivant afin de contribuer à la conservation et à la valorisation du patrimoine du secteur de la chanson, des variétés et du jazz.
Le CNV est en effet chargé de toutes les opérations nécessaires à la perception de la taxe sur les spectacles de musiques actuelles et de variétés (3,5 % des recettes de billetterie), depuis les opérations d'assiette (réception des déclarations), de liquidation (émission des sommes à payer), et de recouvrement (réception et encaissement des règlements). Cette taxe est due par tout organisateur d'un spectacle de variétés, à statut public ou privé, associatif ou commercial, même s'il ne détient pas la licence d'entrepreneur de spectacle. Outre ces redevables, cette taxe est majoritairement acquittée par des entreprises affiliées au CNV, détentrices d'une licence d'entrepreneurs de spectacles. Les fonds ainsi collectés sont redistribués, sous le contrôle économique et financier de l'Etat, sous forme d’aides automatiques et d’aides sélectives (respectivement 65 % et 35 % de la taxe perçue) afin d’améliorer les conditions d’exercice des activités du secteur du spectacle vivant de variétés et de favoriser le développement d’actions d’intérêt commun. Ces aides financières ne sont pas directement versées aux artistes et musiciens, mais aux entreprises de spectacles qui les emploient, c'est-à-dire leurs producteurs mais aussi les salles de spectacles ou les festivals qui les programment.
