Scope and content

Cet instrument de recherche décrit les archives notariales versées par les 48 études qui existaient sur le territoire des Yvelines à la fin du 19e siècle. Chacune d'entre elle, appelée étude principale, peut avoir versé, pour des raisons historiques, les archives d'études plus anciennes éventuellement localisées dans d'autres communes. On parle alors d'études rattachées.

On notera, parmi ces études rattachées, la présence d'études dont le siège se trouvait dans les actuels départements de l'Essonne, l'Eure, l'Eure-et-Loir, es Hauts-de-Seine et du Val d'Oise.

La description du fonds formé par les archives versées par chaque étude est très sommaire, mais donne accès au répertoire numérique qui en décrit précisément le contenu.

Processing information

En 1989, paraissait, sous la direction de Françoise Jenn, le répertoire numérique des minutes et répertoires des notaires versés aux archives des Yvelines entre 1979 et 1987, réalisé par Martine Fournier. Son introduction peut être lue avec profit par qui souhaite mieux comprendre la genèse du classement du fonds. Le classement a ensuite été poursuivi par Geneviève Douillard puis, à compter de 1994, par Rita Perraudin, qui ont été amenées à reprendre la cotation des fonds classées par Martine Fournier. Leur travail a fait l'objet d'un répertoire imprimé en 5 volumes, parus entre 1999 et 2010.

Source of acquisition

Les premiers dépôts de minutiers, effectués en vertu de la loi du 14 mars 1928 autorisant les notaires à déposer aux archives départementales leurs archives ayant plus de 125 ans, furent ceux des notaires de Villepreux (Yvelines) et de Beaumont-sur-Oise (Val d'Oise) en 1931. Des dépôts s'effectuèrent ensuite assez régulièrement jusqu'en 1979, date à laquelle la loi du 3 janvier mit les minutes et répertoires de notaires au rang d'archives publiques, rendant ainsi obligatoire leur versement aux archives départementales.

System of arrangement

Chaque étude principale forme, avec les études qui lui sont rattachées, un ensemble qui porte le nom de la localité dans laquelle l'étude principale est située, suivi, lorsqu'il existe plusieurs études principales dans la même localité, du nom du premier notaire déposant ou versant.

Au sein de la sous-série 3E, chacun de ces ensembles a été classé par ordre alphabétique et se distingue des autres par sa cotation. Par exemple, le fonds d'Hermeray, constitué de l' étude d'Hermeray et des études rattachées de La Boissière, de Mittainville et de Saint-Léger-en-Yvelines, porte la cote 3E 12, tandis que les archives de l'étude de Limay et de ses différentes études rattachées porte la cote 3E 18.

Au sein de chacun de ces ensembles, sont classées d'abord les études rattachées, classées selon l'ordre alphabétique, puis l'étude principale. Dans les deux cas, les répertoires des actes, quand ils existent, sont classés avant les minutes, dans l'ordre chronologique.

Conformément aux dispositions du Code du patrimoine, les documents décrits dans cet inventaire sont librement communicables, sous réserve de leur état de conservation matérielle. S'ils sont disponibles sous forme numérisée ou microfilmée, les originaux ne sont pas communiqués.

Par délibération du 14 février 2014, le Conseil général des Yvelines a placé les documents décrits dans cet inventaire sous licence libre Etalab. Ils sont librement réutilisables, sous réserve de préciser leur provenance.

Ouvrage richement illustré dont le présent instrument de recherche et les répertoires numériques décrivant les fonds de chaque étude sont des adaptations.

Related material

La loi du 10 juillet 1964, entrée en vigueur le 1er janvier 1968, a profondément réorganisé la région parisienne. Elle a supprimé les départements de la Seine (remplacé par ceux de Paris, des Hauts-de-Seine, de la Seine-Saint-Denis, et du Val-de-Marne) et de Seine-et-Oise (remplacé par ceux de l'Essonne, des Yvelines, et du Val-d'Oise). Les nouveaux départements de la région parisienne (Essonne, Hauts-de-Seine, Seine-Saint-Denis, Val-de-Marne et Val-d'Oise) demandent et obtiennent que leur soient transférés les fonds d'archives correspondant à leur ressort territorial. Ces opérations dites de "dévolution" ont amené à transférer des fonds d'études notariales aux départements concernés.Cette particularité doit inciter le chercheur à la plus grande curiosité. En effet qu'elles soient aujourd'hui situées dans les Yvelines ou dans les nouveaux départements, plusieurs études sont limitrophes. Si le principe du classement des archives notariales veut que les études des petites paroisses dépendant d'une étude devenue ensuite étude principale aient été conservées dans le fonds de cette dernière étude, le nombre de ces petites études est tel et leur dépendance géographique a tellement évolué dans le temps, que bien souvent une partie des actes est conservée dans les Yvelines tandis que celles qui leur sont antérieures ou postérieures de quelques années sont dans l'étude d'un département voisin. Le même phénomène se produit d'ailleurs avec des départements limitrophes tels que l'Eure ou l'Eure-et-Loir.

Pour toute recherche portant sur les archives notariales antérieures à la Révolution, on consultera également les actes confiés par les notaires aux greffes des juridictions d'Ancien Régime et versés au 19e siècle aux Archives départementales par les juridictions qui en avaient hérité. Ces documents sont décrits dans l'inventaire intitulé Notaires et tabellions d'Ancien Régime , disponible en ligne.

D'une manière générale, on pourra se reporter en série C au contrôle des actes des notaires, insinuations et centième denier ( consulter l'inventaire en ligne ), ainsi qu'aux archives de l'Enregistrement, classées en sous-série 9Q ( consulter l'inventaire en ligne ) et des Hypothèques, en sous-série 10Q ( consulter l'inventaire en ligne ). Afin de mieux comprendre les liens entre ces sources et les archives notariales, on se reportera pour une présentation générale de ces institutions au guide de Line Skórka (voir orientation bibliographique) et, en ce qui concerne plus particulièrement les Yvelines, au répertoire numérique de la série 9 Q, Enregistrement et Timbre .

Les dossiers de clients constituent une autre source complémentaire, dont le versement est toutefois laissé à la libre appréciation des notaires. Lorsqu'ils ont été confiés aux Archives départementales, ils sont tantôt cotés en série J (documents entrés par don, achat, dépôt),tantôt au sein même de la sous-série 3 E, en fin d'inventaire. Cotés en série J, ils représentent en général des ensembles importants et ont fait l'objet d'un don du notaire versant, puisque ces documents n'entrent pas dans le champ des archives publiques définies par la loi de 1979. (C'est par exemple le cas pour Garancières et Limay). Lorsqu'on les rencontre en sous-série 3 E, c'est qu'ils étaient intégrés au versement des minutes et répertoires, formant quelques liasses isolées.

  • A corporate body, i.e. the name of an institution, organisation, or company (e.g. Ministerie van Justitie, or Electro Mecánica Antonio Armentano)

Please note that this filter will only include institutions, for which a type has been provided as part of their descriptions:

  • A business archive holds the records of (often) commercial organisations.
  • A church or religious archive holds the records of church parishes or religious organisations, e.g. birth or death registers.
  • A county or local authority archive holds the records of the county's administrative bodies.
  • A media archive holds audiovisual or sound records, e.g. a film archive or the archive of a broadcasting company.
  • A municipal archive holds the records of a town or city administration.
  • A national archive holds the records of a country's administrative bodies, i.e. from ministries and other public bodies, sometimes also private papers of former ministers, chancellors, or presidents.
