STRUCTURE

Note:

Deux secrétariats d'État chargés de la Reconstruction furent crées entre 1946 et 1957. Le premier fut rattaché au ministère des Transports, des Travaux publics et de la Reconstruction entre 1946 et 1947 ; le deuxième dépendit du ministère des Affaires économiques et financières entre février 1956 et novembre 1957.

Afin de remplir les missions qui lui étaient assignées, le ministère de la Reconstruction et de l’Urbanisme se dotera, outre les services administratifs d’appui (personnel, finances), d’administrations centrales « métiers », organisées autour de trois grandes directions, dès 1945 : la direction générale de l’Urbanisme, de l’Habitation et de la Construction, devenue direction de l’Aménagement du territoire en 1949 ; la direction générale des Travaux, devenue en 1949, direction de la Construction ; la direction des Dommages de guerre.

HISTORICAL NOTE

Historical note:

Contexte général

Au lendemain de la Seconde Guerre mondiale, la France doit faire face à l’ampleur des destructions. Celles-ci sont sans commune mesure avec celles du conflit précédent. 2 millions d’habitations ont été touchées, 1851 villes ont été ravagées. 120 000 établissements industriels ont été détruits, 250 000 exploitations agricoles ont été endommagées.

Sur tout le territoire, les zones urbanisées avec leurs usines, bâtiments publics, gares, infrastructures de communication sont à reconstruire.

Il faut répondre aux situations d’urgence telles que les opérations de déblaiement, la remise en état de la voirie, le relogement des sinistrés, le dédommagement ou la reconstruction des ouvrages détruits. Mais il faut aussi penser l’avenir avec une vision nouvelle, des perspectives à long terme, en matière d’urbanisme, en inventant un cadre de vie solide et confortable et l’édification de cités modernes.

L’aménagement du territoire devient, par ailleurs, un objectif politique : il faut coordonner la localisation des équipements et des industries en vue d'assurer une meilleure répartition de la population et favoriser ainsi une expansion équilibrée des différentes régions.

La réponse doit être forte, volontariste, planifiée, coordonnée.

Depuis le XIXe siècle, les questions urbanistiques étaient gérées par les autorités administratives et en l’espèce par la section urbanisme de la direction de l’administration départementale et communale du ministère de l'Intérieur. C’est elle qui appliquera les dispositions de la loi de base du 14 mars 1919 dite loi Cornudet sur les plans d’aménagement, d’embellissement et d’extension (PAEE). C'est encore cette section qui suivra la mise en œuvre de la loi du 14 mai 1932 créant la région parisienne ainsi que le décret-loi du 25 juillet 1935 sur les groupements régionaux d’urbanisme.

Après la défaite de 1940, l’État français se dote d’une administration spécifique afin de prendre en charge l’indemnisation des sinistrés et la reconstruction des édifices détruits.

Ainsi, un commissariat à la Reconstruction immobilière est créé par la loi du 11 octobre 1940. Il doit établir les projets de reconstruction et d'aménagement des communes sinistrées. La délégation générale à l'Équipement national (DGEN), instituée par la loi du 23 février 1941, doit établir quant à elle un plan d'équipement de la France et coordonner les questions d'urbanisme et de construction. Elle s'occupe directement des communes non sinistrées, et le commissariat à la Reconstruction est placé sous son égide pour ce qui est des projets d'aménagement des communes sinistrées.

Le ministère de la Reconstruction et de l'Urbanisme (MRU) naît de la fusion de de ces deux entités.

La création du ministère de la Reconstruction et de l’Urbanisme

La création du ministère de la Reconstruction et de l’Urbanisme est actée par un décret du 16 novembre 1944, avec à sa tête Raoul Dautry.

Durant les quelques mois qui suivent, ce nouveau ministère met en place une administration issue de l’ancien commissariat à la Reconstruction et de la DGEN. Elle reçoit dans un premier temps les attributions de celui-ci (décret 30 décembre 1944). Puis son rôle est précisé par l’ordonnance 45-772 du 21 avril 1945. Dans leurs grandes lignes, ces attributions ne seront pas modifiées jusqu’à la création du ministère de la Construction en 1958.

Les attributions sont tout à la fois immédiates et provisoires, mais aussi permanentes.

De manière générale, l’ordonnance du 21 avril 1945 précise que le MRU est chargé :

-de l’ensemble des questions d’urbanisme, sous réserve des droits de tutelle du ministre de l’Intérieur, touchant aux projets d’aménagement et de reconstruction ;

-des questions d’habitation et de construction(y compris la lutte contre le taudis et les îlots insalubres, en accord avec le ministre de la Santé publique pour toutes questions intéressant l’hygiène de l’habitation et des agglomérations), avec la direction et le contrôle de l’activité des entreprises du bâtiment et des professions annexes ou bien la distribution du contingent des matériaux de construction ;

-de la réparation des dommages de guerre causés aux biens: travaux de désobusage, établissement et exécution du plan général de reconstruction, remise en état de la voirie, mise en place et entretien des constructions provisoires, reconstruction des bâtiments et ouvrages publics ou d’immeubles d’habitation.

En matière de logement, le ministre de la Reconstruction contresigne les dispositions législatives ou réglementaires concernant les loyers des Habitations Bon Marché (H.B.M.) et reste consulté sur les projets de dispositions législatives ou réglementaires concernant les loyers des maisons d’habitation ou la profession d’architecte.

Évolution des attributions du ministère entre 1950 et 1958

Un certain nombre de rapports émanant des services du ministère, concernant ses attributions, indiquent dans les années 1950 que celles-ci ont bien été définies par l’ordonnance du 21 avril 1945 « qui reste le texte de base actuellement en vigueur ».

Cependant, à partir de 1945, de nombreux textes législatifs ou réglementaires confient au MRU des tâches nouvelles, notamment en matière de construction et d’urbanisme, qui ont pour effet d’accroître celles qui lui avaient été initialement confiées.

Jusqu’alors, le MRU s’était occupé en priorité des travaux d’urgence ainsi que de la réparation des dommages de guerre. A partir de 1949, il développe de manière décisive une politique du logement et d’aide à la construction. L’insertion du termelogementdans le titre du ministère illustre cette évolution.

De manière générale, les rapports mentionnent que Le ministre est chargé d’élaborer et de mettre en œuvre la politique du gouvernement en matière de logement, de construction, d’urbanisme, d’aménagement du territoire.

Plus spécialement dans le domaine du logement et de la construction, le ministre élabore les textes législatifs et réglementaires relatifs au permis de construire et aux conditions techniques et fonctionnelles de construction ; il en dirige et contrôle l’application.

Il établit le programme de construction de logements et suit leur exécution. Il participe à l’élaboration des textes législatifs relatifs à leur financement. Il impulse toutes dispositions pour faciliter la création de logements et assurer l’entretien et la modernisation de l’habitat rural et urbain.

Le ministre est également chargé :

- de la mise en œuvre de la loi foncière ;

- de l’exécution, dans le cadre du plan d’aménagement de la région parisienne, des décisions concernant le regroupement des locaux occupés par les services publics ;

- de l’exécution des mesures exceptionnelles et temporaires en vue de remédier à la crise du logement ;

- de l’établissement des dispositions législatives et réglementaires concernant les habitations à loyer modéré et du contrôle des organismes HLM

Un rôle particulier en matière d’aménagement du territoire

En matière d’aménagement du territoire, le ministère agira dans ce domaine, sous l’impulsion d’Eugène Claudius-Petit devenu ministre en septembre 1948. Celui-ci présente ses grands axes dans un livre intitulé« Pour un plan national d’aménagement du territoire ». Cet ouvrage dresse les objectifs du nouveau ministre : rééquilibrage des activités, volonté d'étudier les problèmes urbains à l'échelle globale des agglomérations et des régions, développement des transports en commun.

Afin de traduire cette volonté politique en actes, le ministère se dotera, dès 1949, d’une direction de l’Aménagement du territoire qui coiffera à la fois les plans d’aménagement et de reconstruction, les opérations de zoning et celles de décentralisation industrielle. C’est elle qui élabore le plan national d’aménagement du territoire.
