Wettelijke regeling

Ingevolge de inlijving van Nederland bij het Franse keizerrijk, eind 1810, werden diverse Franse wetten op het notariaat hier te lande van kracht. Nieuw was met name de thans voor het hele rijk uniform gereglementeerde organisatie en structuur van het notariaat. Deze Franse wetgeving bleef van kracht tot 1842, in welk jaar de wet op het notarisambt van 9 juli 1842 (Stbl. 20) met ingang van 16 oktober 1842 in werking werd gesteld.

De wet van 1842 bouwde voort op de Franse wetgeving. Bepaald werd, dat de notarissen openbare ambtenaren waren, die door de Koning voor het leven werden aangesteld en hun ambt uitoefenden binnen de grenzen van het arrondissement, waarin hun standplaats was gevestigd. Ingevolge de wet van 6 juli 1830 (Stbl. 46) was de provincie Holland (noordelijk gedeelte) verdeeld in drie arrondissementen, t.w. Amsterdam, Alkmaar en Hoorn, die elk weer in kantons waren onderverdeeld. Artikel 81 a van de wet van 28 april 1835 (Stbl. 10) voegde hieraan een vierde arrondissement toe, dat zou bestaan uit kantons van de eerder genoemde arrondissementen. (Deze wet trad per 1 oktober 1838 in werking). Zo ontstond de volgende indeling:

arrondissement Amsterdam, met de kantons Amsterdam (in totaal vier kantons), Nieuwer-Amstel, Weesp en Naarden.

arrondissement Alkmaar, met de kantons Alkmaar, Schagen en Den Helder.

arrondissement Hoorn, met de kantons Hoorn, Enkhuizen, Medemblik, Purmerend en Edam

arrondissement Haarlem, met de kantons Haarlem, Beverwijk en Zaandam

De wet van 9 april 1877 (Stbl. 77) stelde de zetels vast van de arrondissementsrechtbanken en de kantongerechten binnen het ressort van het gerechtshof te Amsterdam. Voor wat Noord-Holland betreft werd de indeling:

arrondissement Amsterdam, met de kantons Amsterdam (in totaal vier kantons) en Hilversum.

arrondissement Alkmaar, met de kantons Alkmaar, Schagen, Den Helder, Hoorn en Medemblik.

arrondissement Haarlem, met de kantons Haarlem, Zaandam, Purmerend en Haarlemmermeer

De wet trad op 15 mei 1877 in werking. Deze veranderingen in de rechterlijke indeling zijn van belang, omdat de hierboven genoemde wet op het notarisambt van 1842 in art. 4 bepaalde, dat aan iedere notaris bij het besluit van zijn benoeming een standplaats zou worden toegewezen, en wel zodanig, dat er in elk kanton ten minste twee notarissen gevestigd zouden zijn. Bij algemene maatregel van bestuur zou het maximum van het aantal notarissen, die per arrondissement konden worden aangesteld, geregeld worden. Bij de volgende K.B.'s zijn deze maxima geregeld: van 20 september 1842 (Stbl. 23), herzien in 1851 (Stbl. 6), 1861 (Stbl. 8), 1875 (Stbl. 15), 1877 (Stbl. 176) en 1892 (Stbl. 228).

In schema gebracht was het maximum aantal notarissen per arrondissement tussen 1842-1877:

De stijging van het aantal notarissen in het arrondissement Alkmaar in 1877 is het gevolg van de toevoeging van de kantons Hoorn (uitgebreid met het kanton Enkhuizen) en Medemblik aan dit arrondissement.

Hetzelfde gebeurde met het arrondissement Haarlem, dat nu tevens het kanton Purmerend omvatte. De eerdere stijging in dit arrondissement van 18 naar 21 (1861) is onder meer veroorzaakt door de droogmaking in 1855 van de Haarlemmermeer.

Het notarieel protocol

De akten die door de notaris zijn gemaakt, worden opgeborgen in een doorlopende serie op datum van vervaardiging. Wij noemen een dergelijke serie het 'protocol'. Bij verandering van standplaats binnen hetzelfde kanton behield de notaris zijn protocol, dat hij in andere gevallen diende over te dragen. Het protocol van een notaris bestaat niet uit alle door hem gevormde stukken, maar slechts uit de navolgende series: minuutakten, repertoria en registers.

Na het opmaken van de akte behoudt de notaris de minuut, bevattende de goedgekeurde en vastgestelde versie van de akte. Bepaalde gegevens zoals datum en nummer van de akte, soort akte, naam en woonplaats van partij of partijen noteert hij in het repertorium. Aan partij(en) overhandigt hij op verzoek grossen (expedities), afschriften of uittreksels van de akte.

Niet alle genummerde akten zitten in minuutvorm in het protocol: van bepaalde soorten akten hoefde de notaris namelijk geen minuten op te maken en kon het origineel worden afgegeven aan belanghebbende. Wel diende deze in het protocol ontbrekende akten te worden genummerd en vermeld in het repertorium, waarvan steeds een dubbel moest worden gedeponeerd ter griffie van de arrondissementsrechtbank. Het betreft hier o.a. de volgende soorten akten: van huwelijkse toestemming en van bekendheid, volmachten, verklaringen van eigendom of van het in leven zijn van personen, diverse soorten kwitanties, akten van toestemming tot doorhaling of vermindering van hypothecaire inschrijvingen. Bij sommige notarissen vindt men naast deze doorlopende nummering van alle door hen opgemaakte akten een nummering die de werkelijk aanwezige akten aangeeft. Ten einde het repertorium als ingang te kunnen gebruiken zijn in de inventaris steeds de eersten, dus de hoogste aktenummers, vermeld.

Het register ten slotte bevat afschriften van wissel- en chequeprotesten volgens het Wetboek van Koophandel.

Overbrenging notariële archieven

De notarissen dienden de archieven van hun voorganger, voorzover de bescheiden ouder waren dan 30 jaar, over te brengen naar een algemene bewaarplaats in de arrondissementsrechtbank, waaronder hun standplaats ressorteerde. Ook het door henzelf gevormde archief voor zover ouder dan 30 jaar konden zij desgewenst en na machtiging van de rechtbank overbrengen naar deze bewaarplaats.

De wet van 30 december 1904 (Stbl. 283) stelde de overbrenging voor van de notariële archieven van vóór de invoering van de Franse wetgeving naar de rijksarchiefbewaarplaatsen. Ten aanzien van de notariële archieven van na 1811 werd in deze een termijn van 75 jaar aangehouden: de overbrenging van de bescheiden uit de periode 1811-1842 kwam tot stand na de Archiefwet-1918 en ingevolge Besluit van 18 augustus 1919 (Stbl. 546). Deze regeling is in de praktijk nog steeds van kracht.

Verantwoording van de inventarisatie

De inventaris omvat de archieven van notarissen van de arrondissementen Alkmaar, Amsterdam en Haarlem voorzover deze niet aan een gemeentelijke of streekarchiefdienst in bewaring zijn gegeven en zich bij het rijksarchief bevinden.

Bij de her-inventarisatie is een ander systeem gevolgd dan in de beide voorlopige inventarissen die onderling ook weer verschilden.

De archieven van de notarissen zijn in de eerste plaats per standplaats ingedeeld, waarbij de standplaatsen in alfabetische volgorde zijn gebracht. Resideerden er gelijktijdig in één plaats meerdere notarissen dan zijn 'notariskantoren' gereconstrueerd, die door middel van een Romeins cijfer zijn aangeduid. Binnen de plaats c.q. het notariskantoor zijn de bescheiden chronologisch gerangschikt. Hierbij is de volgorde per notaris steeds: a. repertoria, b. protestregisters en c. minuutakten. Deze opzet maakt het mogelijk nieuwe aanvullingen zonder wijziging in de nummering te kunnen verwerken. Het gevolg hiervan is dat er in de praktijk voor iedere notarisplaats een zelfstandige deelinventaris is ontstaan, met een apart toegangsnummer. Deze toegangsnummers zijn iedere keer in de titel van de deelinventaris vermeld.

Tijdens de inventarisatie werden van verscheidene notarissen akten aangetroffen uit de laatste maanden van 1842. Deze zijn steeds teruggebracht naar het archief daterend van vóór 1843. Op dezelfde inventaris is men aangewezen indien een notaris zijn repertorium reeds vóór 1843 begon.

Veranderde een notaris van standplaats dan ging hij meestal in hetzelfde repertorium verder, gesteld dat dit nog niet 'vol' was. In zo'n geval is het, afhankelijk van het aantal daar doorgebrachte jaren, óf bij de eerste óf bij de tweede standplaats opgeborgen, wat uit verwijzingen blijkt. Slechts in enkele gevallen ontbreken de repertoria geheel.

Opmerking: als ingang op de notariële archieven, voorzover het testamenten betreft, kunnen dienen de zgn. 'Testamentenklappers'(register VI), 19e eeuw-ca. 1925, gedeponeerd bij het archief Successie vanaf 1818.

Zoekinstructies

Voor u gaat zoeken in het notarieel archief zijn er een paar zaken waar u rekening mee moet houden. De gegevens die aangeboden worden zijn de notariële akten die door de betreffende notaris in opdracht van derden zijn opgemaakt. Over de notaris zelf vindt u er dus geen gegevens. Ook eventuele correspondentie die de notaris heeft gevoerd vindt u er niet in terug. Wilt u gaan zoeken, dan kunnen we uitgaan van een tweetal mogelijkheden:

u weet al dat een bepaalde akte opgemaakt (dat wordt ook wel aangeduid met de term 'verleden') is voor notaris X in plaats Y;

u wilt weten of er over bepaalde personen of gebeurtenissen gegevens te vinden zijn in het notarieel archief.

In het eerste geval kunt u in het hierna volgende overzicht onder de betreffende plaats gaan zoeken of er archief van deze notaris te vinden is, vervolgens selecteert u het inventarisnummer (soms ook aangeduid met de term 'bestanddeelnummer') en vraagt dat aan (het inventarisnummer is het nummer van het stuk op pak stukken dat u aan wilt vragen).

Wat moet u doen als u nog geen gegevens hebt, maar gewoon wilt weten of er gegevens zijn?

1. u bedenkt welke plaats in aanmerking komt. Soms is er in de woonplaats van iemand geen notaris gevestigd. U zou dan eens kunnen kijken in een plaats in de directe omgeving. Soms kan dat een plaats zijn waar een weekmarkt werd gehouden, een bezoek aan de markt werd dan gecombineerd met een bezoek aan de notaris.

2. u vraagt vervolgens het repertorium van de in aanmerking komende notaris(sen) op. Het repertorium is een kort overzicht van de soort akten, met de namen van de personen die bij het maken van de akten betrokken waren. Het repertorium is chronologisch ingericht, dat wil zeggen: op volgorde van datum van het maken van de akten. Elke akte heeft een nummer gekregen, en in principe kunt u de akten onder dat nummer terug vinden. Noteert u daarom de datum en het aktenummer.

3. Let op! Sommige akten worden 'in brevet' gemaakt. Dat wil zeggen dat de notaris een akte maakte, deze liet ondertekenen door de betreffende persoon of personen en deze dan vervolgens in origineel meegaf. Van een dergelijk brevet is dus geen exemplaar te vinden tussen de akten. U moet het dan doen met de korte omschrijving uit het repertorium.

4. u hebt nu de datum en het aktenummer van de akte waarin u geïnteresseerd bent. Vervolgens zoekt u in de toegang de serie minuutakten op, deze zijn geordend op jaar. Soms zijn er meer pakken over hetzelfde jaar. In dat geval is zonodig de periode aangegeven, en de aktenummers die het betreffende inventarisnummer bevat. Selecteer vervolgens het inventarisnummer dat de door u gezochte akte bevat en vraag dat aan.

Voor het aanvragen hebt u naast uw eigen bezoekersnummer en het inventarisnummer ook het toegangsnummer nodig. Dit vindt u duidelijk vermeld in de titel van iedere paragraaf, het is het nummer dat begint met 186.

Indien u dit wilt kunt u van de gevonden akte(n) een kopie laten maken. U mag dit niet zelf doen. Bij de informatiebalie in de studiezaal kunt u zonodig inlichtingen hierover vragen.

Protestregister

Bij sommige notarissen vindt u naast het repertorium en de minuutakten ook een omschrijving 'protestregister' vermeld. Dit betreft weigeringen tot uitbetaling van wissels, die via de notaris gedaan worden. Deze akten komen niet voor in het repertorium. U zult ze dus stuk voor stuk door moeten nemen. Aangezien het vaak slechts enkele exemplaren betreft hoeft dit geen bezwaar te zijn.
