Ten geleide

Bij besluit van Provinciale Staten van Gelderland van 1 april 1957 (Provinciaal Blad nr. 32 van 2 mei 1958) werd per 1 juli 1958 in het leven geroepen het Polderdistrict Oude Rijn en werden tegelijkertijd opgeheven:
het polderdistrict Herwen, Aerdt en Pannerden
de Rosandsche polder
de buitenpolder de Pannerdensche Waard
de buitenpolder 's-Gravenweerd
de Eendenpoelsche buitenpolder,
wier archieven ingevolge artikel 20 van genoemd besluit aan het nieuwe polderdistrict moesten worden overgedragen.

De beschrijving van deze " oude archieven ", met de eventuele gedeponeerde archieven, alsmede van het archief van de in 1968 opgeheven en bij het gebied van het Polderdistrict Oude Rijn gevoegde buitenpolder Netterden, vindt de gebruiker hierachter.
De ordening en inventarisatie van de archieven vond plaats in de jaren 1973-1975 waarbij wegens het praktisch geheel ontbreken van enige oorspronkelijke ordening te werk is gegaan naar analogie van andere, vergelijkbare polderarchieven.
De door de onderscheidene besturen ontvangen en hier en daar slechts fragmentarisch bewaard gebleven series Provinciale Bladen en Provinciale Aanschrijvingen zijn zo veel mogelijk verzameld tot min of meer complete series, en beschreven in het aanhangsel tot deze inventaris. De dubbelen hiervan alsmede zeer grote hoeveelheden vernietigbare stukken zijn verwijderd.

Algemene inleiding

Het Polderdistrict Herwen, Aerdt en Pannerden dateert van 1838, in welk jaar het reeds in 1831 vastgestelde en bij K.B. van 23 september 1837 nr. 57 bekrachtigde Reglement op het beheer der rivier-polders in de Provincie Gelderland in werking trad.

In dit reglement stond het polderdistrict vermeld onder de polders der tweede klasse, hetgeen ondermeer inhield dat het bestuur behalve uit een dijkgraaf uit twee heemraden en vier hoofdgeërfden bestond.
Het district werd omschreven als bevattende " de landen, gelegen onder de dorpen Herwen, Aerdt en Pannerden, binnendijks aan de oostzijde van het kanaal gelegen, welke elk een afzonderlijk bestuur der 3e klasse hebben, bestaande uit 2 leden, hebbende eene gegoedheid van ten minste 3 bunders ". Een en ander slaat op de dorpspolders, die eveneens in 1838, in de voetsporen van de tot dan toe bestaan hebbende dijkbesturen waren getreden, en wier archieven tezamen met die der hiermede verweven geërfdenorganisaties ingevolge artikel 7 van Provinciaal Blad nr. 90 van 15 december 1837 naar het nieuw gevormde polderdistrict werden overgebracht.

Van oudsher stonden de genoemde geërfdenorganisaties en dijkbesturen onder het gezag van het Ambt Overbetuwe. Sinds de totstandkoming van het Pannerdens Kanaal in 1707, waardoor het onderhavige gebied in feite geheel van de Betuwe werd afgescheiden, werd de band daarmede steeds losser, om ten slotte omstreeks het midden van de vorige eeuw geheel te verdwijnen.
De drie zogenaamde binnenpolders, namelijk die in de kerspelen Herwen en Aerdt en de Heerlijkheid Pannerden stonden voor 1838 ieder onder het bestuur van een afzonderlijke dijkstoel, bestaande uit een dijkgraaf met enige heemraden.

In het kerspel Herwen bestond in de tweede helft van de 18e eeuw geen meer en werden de dijkzaken en weteringzaken behartigd door de richter van Herwen en Aerdt met de buurmeesters van Herwen, en later door de schout van Herwen, Aerdt en Pannerden met buurmeesters. Op de Herwense geërfdendag van 29 april 1811 werd geconstateerd " dat de post van schout van Herwen, Aerdt en Pannerden met de invoering van de Franse regterlijke magt zijnde komen te vervallen, het collegie van Schout en buurmeesteren hetwelk totdusverre met de werkzaamheden van den Dijkstoel van Herwen is belast geweest, niet meer bestaat ". Men besloot toen de buurmeesteren van de zorg voor dijken en weteringen te ontslaan en een dijkstoel, bestaande uit een dijkschrijver, tevens eerste heemraad, en een aantal heemraden en noodheemraden te benoemen. Bij geërfdenbesluit van 28 april 1819 werd de titel van 1e heemraad vervangen door die van dijkgraaf.

In Aerdt was reeds omstreeks het midden van de 14e eeuw de " dijkscouwe " een van de rechten, die door de Heer van Aerdt als erfdijkgraaf werd uitgeoefend, terwijl in de Heerlijkheid Pannerden zowel dijkgraaf als heemraden door de Heer werd(en) benoemd.
De omvang van de polders waarin de bovengenoemde dijkbesturen actief waren komt min of meer overeen met die der latere dorpspolders. Het territoir der geërfdenorganisaties was over het algemeen ruimer. Zo omvatte het gebied der gezamenlijke geërfden van Pannerden ondermeer: de latere dorpspolder Pannerden, de Pannerdensche Waard, de Honderd Morgen, benevens de buitenlanden Lobberden, Pannerdensche Buitenwaard, Klompenwaard etc. De bemoeiingen der geërfden strekten zich ook verder uit dan die der polderbesturen, die zich slechts met waterstaataangelegenheden bezig hielden, en die, vanwege het feit dat de drie polders waterstaatkundig gezien eigenlijk één geheel vormden, min of meer hecht met elkander samenwerkten.

De dorpspolders Herwen, Aerdt en Pannerden werden bij besluit van Provinciale Staten van 26 juli 1920 (Provinciaal Blad nr. 133 van 1920) opgeheven (per 1 juli 1921). Het polderdistrict werd bij die gelegenheid verdeeld in drie afdelingen waarvan de grenzen overeenkwamen met die van de opgeheven dorpspolders, ieder met een eigen comptabiliteit. De archieven van de opgeheven dorpspolders werden ingevolge artikel 7 van bovengenoemd besluit bij het archief van het Polderdistrict geplaatst.

Het feit dat de dorpspolders ingevolge het rivierpolderreglement onder een verregaand toezicht stonden van het polderdistrict heeft ten gevolge gehad dat bijvoorbeeld zowel in het archief van het district als in dat der onderscheidene dorpspolders min of meer volledige series begrotingen en rekeningen voorhanden waren. Om praktische redenen is in dergelijke gevallen steeds een zo volledig mogelijke serie gemaakt en beschreven onder de desbetreffende dorpspolder, waarna het restant werd vernietigd.

Omstreeks 1891 is door G.L. van den Helm, burgemeester van Batenburg, in opdracht van het Provinciaal Bestuur een alfabetische inventaris gemaakt van de archieven van het polderdistrict en de voormalige dijkbesturen. De nummers 78 en 79 van bedoelde inventaris, twee verpondingskohieren betreffende, werden niet aangetroffen, en bleken in 1917 aan het Rijksarchief in Gelderland te zijn afgestaan.
In 1936 werd het archiefbestand, dat tot dan toe bij de secretaris had berust, geplaatst in een daarvoor ingerichte ruimte in het gebouw van het pompgemaal aan de Deukerdijk, vanwaar het enige jaren geleden naar Huis Aerdt werd overgebracht.

Inleiding

De 's-Gravenweerd behoorde oorspronkelijk tot de Pruisische domeinen, die ook de omringende dijken met de daarin gelegen sluis onderhielden.
Gedurende de Franse overheersing moet de 's-Gravenweerd in gedeelten zijn verkocht, als gevolg waarvan ook het genoemde onderhoud ophield. Derhalve was er nu een reden ontstaan om tot een polderorganisatie te komen. In een daartoe op 17 september 1815 bijeengeroepen vergadering van geërfden werd een dijkreglement vastgesteld, dat op 13 februari 1817 door de ( Pruisische ) overheid werd goedgekeurd. Als dijksbestuurderen traden in die jaren op: Carl Geitman, dijkgraaf, en Peter Jansen en Theodorus Derksen, heemraden.

Na de overgang naar Nederland in 1817 heeft men getracht om ca. 30 morgens land onder Herwen bij de polder te voegen, hetgeen echter op juridische gronden door Gedeputeerde Staten van Gelderland werd afgewezen.
In de dertiger jaren ontstonden in de boezem van het bestuur allerlei moeilijkheden, wat geen wonder mag heten met een persoon als Carl Geitman als dijkgraaf. Deze was het ook die na zijn aftreden weigerde het archief over te dragen. Omstreeks 1835 bestond het bestuur, dat toen nog steeds volgens het Kleefse Waterrecht van 1767 te werk ging, uit een dijkgraaf, twee heemraden en twee gedeputeerden. In het Gelders Rivierpolderreglement van 1837 komt de 's-Gravenweerd voor onder de polders der derde klasse.
Het grootste gedeelte van het archief blijkt in de laatste wereldoorlog te zijn verloren gegaan.
