Einleitung

Im folgenden Inventar ist nur ein Teil des Nachlasses von Wolfgang Heine(*) verzeichnet. Ein anderer Nachlassteil befindet sich im Deutschen Zentralarchiv Potsdam(**).

Der vorliegende Teil enthält Material aus der Zeit 1896-1928, das aufgrund der beruflichen und politischen Funktionen entstanden oder zusammengebracht worden ist. Personalpapiere, persönliche Aufzeichnungen und Privatkorrespondenz sind im wesentlichen nicht in dem Bestand enthalten.

Die Gliederung des Nachlassguts nach Sachgruppen, wie sie durch die Titel I bis XIX(***) zum Ausdruck kommt, geht im grossen und ganzen wahrscheinlich auf W. Heine (oder auf die Registratur seines Anwaltsbüros) zurück und ist - bis auf einige Korrekturen - so übernommen worden. Abgesehen von dem wenig ausführlichen Verzeichnis der „Aktenstücke in Sachen Rothardt" (siehe unter Nr. 569), das auch mit der alten Ordnung nicht immer übereinstimmte, und angesehen von den kurz gehaltenen Aufschriften auf den Aktenmappen fanden sich keine weiteren Verzeichnisse des Nachlassinhalts. An einigen Stellen waren Schriftstücke durcheinandergeraten bzw. Aus ihren Verband (der entsprechenden Sachgruppe) gelöst.

Der Nachlassordner hat die Titel der Sachgruppen neu formuliert oder verändert. Die Ordnung innerhalb der Sachgruppen (zumeist nach Schriftstückarten) geht ebenfalls auf ihn zurück. Die Gruppen selbst sind - ausgehend von ihren jeweils für den Vorgang oder die Sammlung massgeblichen ältesten Stücken - in chronologischer Reihenfolge beschrieben worden.

Der Nachlass beginnt mit den Dokumenten des Prozesses gegen Ignaz Auer und Gen., 1896/1897, die aus der Rechtsanwaltspraxis Heines stammen (siehe unter I.). Das folgende Material zum „Vereins- und Versammlungswesen" (Gesetzgebung, Rechtsprechung etc.) lässt sich sowohl mit der Rechtsanwaltstätigkeit in Verbindung bringen (siehe unter II.). Die Zusammenstellung dieses Material datiert wohl seit der Vereinsenquete des SPD-Parteivorstandes und der Beratung der den Entwurf eines Reichsvereinsgesetzes im Reichstag 1907/1908. Die Sammlung der Zeitungsausschnitte zur „Budgetfrage" (siehe unter III.) basiert u.a. auf der Beteiligung des „Budgetfrage" (siehe unter III.) basiert u.a. auf der Beteiligung des SPD-Mitglieds Heine an dem Richtungsstreit innerhalb der sozialdemokratischen Partei, 1908-16, während das Material zu den Gesetzentwürfen und Parlamentsberathungen (siehe unter IV. Und dann unter VII.-X.) seiner Tätigkeit als Reichstagsabgeordneter zugeordnet werden kann. Die Schriftstücke zum Prozess gegen die Angeklagten der Strassenunruhen in Berlin-Moabit (1910-1911) und zum Prozess gegen die sozialdemokratischen Mitglieder des preussischen Abgeordnetenhauses Borchardt und Leinert (1912-1913) belegen Heine Rolle als Verteidiger in beiden Prozessen (siehe unter V. und VI.). Als prominenter sozialdemokratischer Reichstagsabgeordneter und Jurist nimmt er an der Zusammenkunft zur Besprechung der Gestaltung der Völkerbeziehungen nach dem Kriege, die im November 1917 in Bern stattfindet, teil (siehe unter XI.) und erhält gegen Ende des Krieges die ersten Publikationen der Zentrale für Heimatdienst zugeschickt (siehe unter XII.). Das unter XIII. - XV. Verzeichnete Material ist im Zusammenhang mit seiner Funktion als preussischer Justizminister (1918-März 1919) und als preussischer Innenminister (März 1919-1920) entstanden oder in seinen Besitz gekommen. Kurz nach dem Kapp-Putsch scheidet Heine aus dem Ministeramt aus (siehe dafür auch unter XV.). So wie er vor 1914 auch publizistisch für die Volksgerichte plädiert hat, so lehnt er nach 1921 die Entwicklung der bayerischen Volksgerichte ab (siehe die Sammlung zu den Volksgerichten in Bayern unter XVI.). Als Anwalt des Nebenklägers Friedrich Ebert nimmt Heine 1923/24 an dem Verfahren gegen den Schriftsteller Emil Gansser (siehe unter XVII.) und an dem bekannten Magdeburger Prozess gegen den Redakteur Erwin Rothardt (1924/1925) teil. Die Schriftstücke zum Magdeburger Prozess (siehe unter XVIII.) bilden neben II. Die umfangreichste Sachgruppe des Nachlassbestandes. Eine Korrespondenz mit dem SPD-Mitglied Robert Scholz beschliesst den vorliegenden Nachlassteil (siehe unter XIX.).

Es sei noch vermerkt, dass man unter der Inventarbezeichnung „Zeitungsausschnitte" im Nachlass auch vollständige Zeitungsexemplare antreffen wird, ohne dass diese gesondert verzeichnet sind.
