Scope and content

La conservation des hypothèques est chargée d'assurer le service public de la publicité foncière, c’est-à-dire qu’il a pour mission principale d’enregistrer (la loi dit « publier ») et de centraliser des copies certifiées conformes à l’original des actes et des contrats relatifs aux biens immobiliers (ventes, donations,échanges, etc). Les notaires, après avoir établi les actes authentiques relatifs aux immeubles, doivent les déposer au service des hypothèques, qu'il s'agisse de transactions ou de garanties. Dès lors, la Conservation des hypothèques représente une mine d'informations et permet d'accéder aux informations contenues dans ces actes, dont la teneur est enregistrée dans des registres dits "registres de formalités". Les registres d'ordre permettent de déterminer dans quel registre de formalités doit être rechercher la transcription d'un acte, lorsque le lecteur ne dispose pas des références exactes de cette transcription (numéro de volume et numéro de la transcription).

LES REGISTRES D'ORDRE

Pour être certain de mener à bien sa recherche, le lecteur consultera successivement et dans cet ordre :

Le registre indicateur de la table alphabétique du répertoire : il facilite le repérage dans la table et renvoie aux volumes de la table alphabétique ; cependant son utilisation n'est pas obligatoire.

Dans la plupart des cas peut se reporter directement aux tables alphabétiques du répertoire.

La table alphabétique indique dans l'ordre alphabétique, les noms, prénoms et domicile des personnes concernées par les hypothèques ainsi que les numéros de volume des répertoires et la case auxquels il faut se reporter pour accéder aux transcriptions.

Le répertoire des formalités hypothécaires : pour chaque individu répertorié aux hypothèques, figure, dans des cases, l'intégralité des opérations financières, avec les mentions, acquisition, ou vente, les dates de transcription et dans deux colonnes le numéro de volume et numéro de transcription correspondant aux opérations que l'on recherche. Après avoir noté ces références, on peut se reporter aux registres de formalisé

À noter que les registres d'ordre du bureau de Rambouillet n'ont jamais été versés aux archives départementales, mais ont été transférés au centre de conservation d'Auxerre ; ils devraient revenir aux archives départementales, mais dans cette attente les relevés de formalités donnant accès aux registres de transcription sont à demander à Auxerre.

LES REGISTRES DE FORMALITES

Ce sont les volumes sur lesquels sont portés, par ordre de date les inscriptions d'hypothèques et les transcriptions d'actes de mutation et de saisie. Nous citerons les registres d'inscription des privilèges et hypothèques, les registres de transcription des actes translatifs de propriété d'immeuble, les registres de transcription des saisies immobilières et des dénonciations de saisie et les registres des dépôts.

Les registres de transcription des actes translatifs de propriété d'immeuble sont quasiment les seuls consultés en salle de lecture ; les registres d'inscription le sont à titre exceptionnel.

HISTORIQUE DE L'INSTITUTION

L'hypothèque est une notion fondamentale de droit civil. Elle appartient à la catégorie juridique des sûretés, c'est un moyen de garantir le crédit en protégeant le créancier. En effet, la dette contactée par l'emprunteur est gagée sur le bien immobilier du débiteur. À défaut de règlement dans les conditions prévues, le bien hypothéqué peut être saisi et vendu aux enchères.

L'hypothèque trouve son origine dans le droit romain ; elle portait alors indifféremment sur les biens meubles et immeubles. Le droit coutumier la restreignit aux immeubles.

Parallèlement au contrôle des actes de plus en plus affirmé sous l'Ancien Régime, les hypothèques furent mises en place essentiellement au cours du XVIIIe. Après une tentative de Colbert en 1673, avec notamment la création du titre de Conservateur des hypothèques, c'est l'édit de juin 1771, couramment appelé " édit sur les hypothèques " qui en fixe les grandes règles.

Les lois du 9 messidor an III (27 juin 1795) et du 11 brumaire an VII (1er novembre. 1798), organisèrent la publicité des hypothèques avec l'inscription obligatoire sur des registres publics de tout acte translatif de droits susceptibles d'hypothèque . La "conservation des hypothèques " a été réellement organisée par la loi du 21 ventôse an VII (11 mars 1799) qui crée un bureau dans chaque arrondissement.

Ces dispositions furent en partie reprises dans le Code civil.

Enfin, c'est le décret-loi du 4 janvier 1955 qui étendit l'obligation de transcription à tout acte et décision translatif, déclaratif ou constitutif de droits réels immobiliers. Avec la réforme de 1955 fut mis en place, à partir du 1er janvier 1956 un fichier immobilier, qui permet une recherche de formalités par propriétaire et par commune.

LES BUREAUX DES HYPOTHEQUES DE L'ANCIEN DEPARTEMENT DE SEINE-ET-OISE

La loi du 21 ventôse an VII établit un bureau par arrondissement : Corbeil, Étampes, Mantes, Pontoise, et Versailles ; auxquels s'ajoute l'arrondissement de Rambouillet en 1812.

Le décret du 23 novembre 1900 a divisé en plusieurs bureaux certaines conservations importantes, tel est le cas pour Versailles.

On découvrira toutefois dans le corps du présent répertoire numérique l'existence éphémère (an VII-an IX) d'un bureau des hypothèques à Saint-Germain-en-Laye et l'on se reportera à l'introduction propre à ce bureau pour en comprendre les modalités.

L'historique de l'entrée des documents aux archives (voir infra), explique le fait que les archives des Yvelines n'aient conservé que les documents du ressort des arrondissements de Mantes, Rambouillet et Versailles, contrairement aux archives d'autres institutions dont la dévolution a dû être faite aux nouveaux départements issus de l'Ancienne Seine-et-Oise.

Il est à noter toutefois qu'un certain nombre de communes de l'Essonne, relevant depuis sa création en 1970 du bureau des hypothèques de Palaiseau , dépendaient jusqu'à cette date du bureau de Versailles ou de celui de Rambouillet (Dépendaient du bureau de Versailles : Bièvres, Bures-sur-Yvette, Gif-sur-Yvette, Igny, La Ville-du-Bois, Nozay, Orsay, Palaiseau, Saclay, Saint-Aubin, Vauhallan, Verrières-le-Buisson, Villebon-sur-Yvette, Villejust, Villiers-le-Bâcle.

Dépendaient du bureau de Rambouillet : Boullay-les Troux, Briis-sous-Forges, Courson-Monteloup, Fontenay-les-Briis, Forges-les-Bains, Gometz-la-Ville, Gometz-le-Châtel, Janvry, Limours, Marcoussis, Les Molières, Pecqueuse, Saint-Jean-de-Beauregard, Vaugrigneuse).

Source of acquisition

La première entrée fut effectuée par la Conservation des hypothèques de Versailles le 28 juillet 1937 ; elle portait sur les registres de transcriptions de l'an VII à 1815 pour les bureaux de Versailles et Saint-Germain-en-Laye ainsi que des registres d'inscription de l'an VII à 1835. En 1973 fut versé un complément des transcriptions du XIXe pour les bureaux de Mantes, Rambouillet et Versailles.

Enfin en 1983 et 1988 le centre de conservation des hypothèques de Meaux (centre ayant précédé celui d'Auxerre comme centre de conservation intermédiaire) versait le complément des documents, jusqu'en 1900 transcriptions, inscriptions, tables etc.

Conditions governing access

Seuls les registres des hypothèques de plus de 100 ans sont librement communicables au public.

Un certain nombre de documents, principalement parmi les registres d'ordre ne sont consultables que sous forme de microfilms.

À ce jour, les archives départementales des Yvelines conservent les documents antérieurs à 1901.

Les répertoires et actes compris entre 1901 et 1955 sont à rechercher auprès de la Conservation des hypothèques, archives d'Auxerre, 1er bureau (8 rue des Moreaux BP 29 89010 AUXERRE CEDEX, tél. : 03 86 72 50 00)

Les actes postérieurs au 1er janvier 1956 à rechercher auprès de la Conservation des hypothèques de Versailles, 1er bureau (2, rue de l'école des postes 78000 VERSAILLES).

RECHERCHER DANS LE FONDS DES HYPOTHEQUES

Il faut connaître au minimum le nom, le prénom et la date de naissance de la personne concernée. S'agissant des biens, le nom de la commune concernée permet de déterminer dans quel arrondissement ils se situent et donc auprès de quelle conservation des hypothèques l'acte a été transcrit.

D'une manière générale, en matière d'hypothèques avant 1954, la recherche se fait, uniquement sur le NOM des parties et en trois étapes :

étape 1 : l'indicateur au nom cherché renvoie à l'une des tables ;

étape 2 : la table renvoie à un compte dans un des répertoires ;

étape 3 : le répertoire renvoie au volume et au numéro de transcription.
