-) Reichs-Gesetz-Blatt für das Kaiserthum Österreich, 44. Gesetz vom 19. Mai 1868, über die Einrichtung der politischen Verwaltungsbehörden in den Königreichen Böhmen, Dalmatien, Galizien und Lodomerien mit den Herzogthümern Auschwitz und Zator und dem Großherzogthume Krakau, den Erzherzogthümern Österreich unter und ob der Enns, den Herzogthümern Salzburg, Steiermark, Kärnthen, Krain, Bukowina, der Markgrafschaft Mähren, den Herzogthümern Ober- und Nieder-Schlesien, der gefürsteten Grafschaft Tirol und dem Lande Vorarlberg, der Markgrafschaft Istrien, der gefürsteten Grafschaft Görz und Gradiska und der Stadt Triest mit ihrem Gebiete. Dieses Gesetz verfügte u.a. die Trennung der politischen Verwaltung von der Rechtspflege in allen Instanzen und die Einteilung der Länder in politische Amtsbezirke. Diese landesfürstlichen politischen Bezirksbehörden hatten die Bezeichnung "Bezirkshauptmannschaften" zu führen; an ihre Spitze trat der Bezirkshauptmann, der vom Minister des Innern ernannt wurde.
-) Reichs-Gesetz-Blatt für das Kaiserthum Österreich, 101. Verordnung des Innern vom 10. Juli 1868, die Durchführung des Gesetzes vom 19. Mai 1868 (Reichs-Gesetz-Blatt Nr. 44) in Böhmen, Dalmatien, Österreich unter und ob der Enns, Steiermark, Kärnthen, Bukowina, Mähren, Schlesien, Tirol und Vorarlberg, Istrien, Görz und Gradiska betreffend. Mit dieser Verordnung wurde u.a. die territoriale Einteilung des Erzherzogtums Österreich unter der Enns in 18 k.k. Bezirkshauptmannschaften und 70 Gerichtsbezirke verfügt. Diese politischen Behörden I. Instanz nahmen mit 31. August 1868 ihre Tätigkeit auf. Auch die k.k. Bezirkshauptmannschaft (BH) Amstetten wurde damals wieder errichtet; sie bestand zunächst aus den Gerichtsbezirken Amstetten, Haag, Ybbs, Waidhofen an der Ybbs (ohne Stadt), St. Peter in der Au und Persenbeug.
-) Reichsgesetzblatt für die im Reichsrathe vertretenen Königreiche und Länder, 135. Kundmachung des Ministeriums des Innern vom 24. Juli 1896, betreffend die Errichtung einer Bezirkshauptmannschaft Melk in Niederösterreich. Mit dieser Kundmachung erfolgte mit 1. Oktober 1896 die Eingliederung des Gerichtsbezirkes Ybbs in die neu errichtete BH Melk.
-) Reichsgesetzblatt für die im Reichsrathe vertretenen Königreiche und Länder, 135. Kundmachung des Ministeriums des Innern vom 10. August 1899. Gemäß dieser Verfügung fiel der Gerichtsbezirk Persenbeug mit 1. Oktober 1899 an die neu geschaffene BH Pöggstall.
-) Verordnungsblatt für den Amtsbereich des Landeshauptmannes von Niederdonau, 37. Verordnung des Landeshauptmannes von Niederdonau vom 12. Oktober 1938 über die Einteilung des Amtsbereiches Niederdonau in Verwaltungsbezirke. Diese Verordnung verfügte u.a. die Vergrößerung des Verwaltungsbezirkes Amstetten um den bisherigen Stadtbezirk Waidhofen an der Ybbs.
-) Staatsgesetzblatt für die Republik Österreich, 66. Gesetz vom 10. Juli 1945 über die vorläufige Neuordnung des Gemeinderechtes (Vorläufiges Gemeindegesetz - VGemG.). Dieses Gesetz verfügte u.a. die Wiedererrichtung von Waidhofen an der Ybbs als Stadt mit eigenem Statut. Es bestimmte aber gleichzeitig, dass die Geschäfte der Bezirksverwaltungsbehörde bis zur tatsächlichen Übernahme durch die hiezu berufenen Gemeindeorgane von der Bezirkshauptmannschaft Amstetten weiterzuführen sei. Dieser Zustand war mit 1. Juni 1946 erreicht, und die BH Amstetten bestand nun auch de facto nur mehr aus den Gerichtsbezirken Amstetten, Haag, St. Peter in der Au und Waidhofen an der Ybbs (ohne Stadt).
-) Gesetzblatt für das Land Österreich, 626. Kundmachung des Reichsstatthalters in Österreich, wodurch die Dritte Verordnung über den Neuaufbau des Reichs vom 28. November 1938 bekanntgemacht wird. Diese Verordnung verfügte mit Wirkung vom 1. Jänner 1939 u.a., dass die Bezirkshauptmannschaft künftig "Der Landrat" und die Verwaltungsbezirke dieser Behörden "Landkreise" zu heißen hatten. Der Bezirkshauptmann führte fortan die Amtsbezeichnung "Landrat".
-) Staatsgesetzblatt für die Republik Österreich, 94. Gesetz vom 20. Juli 1945 über die Überleitung der Verwaltungs- und Justizeinrichtungen des Deutschen Reiches in die Rechtsordnung der Republik Österreich (Behörden-Überleitungsgesetz - Behörden-ÜG.). Dieses Gesetz verfügte u.a. den Übergang der in den Landkreisen von den Landräten besorgten Verwaltung auf die Bezirkshauptmannschaften.
-) Amtsunterricht für die k.k. Bezirkshauptmannschaften in Niederösterreich. (Leitfaden für die neu einzuführende Kanzleiordnung, verfasst bei der n.ö. Statthalterei.) 2. Aufl., Wien 1905, Beilage 7, Geschäftsplan für die Kanzleiabteilungen der k.k. niederösterreichischen Statthalterei. (Die Gruppen und Abschnitte übereinstimmend mit den Geschäftsplänen des k.k. nö. Landesschulrates, der k.k. Bezirkshauptmannschaften und Bezirksschulräte in Niederösterreich.): Dieser Geschäftsplan bildete von 1904 bis 1925 im Wesentlichen die Grundlage für die Behandlung der Kanzleigeschäfte der Bezirkshauptmannschaften. Er war in 16 Gruppen und 235 Abschnitte gegliedert:

-) Geschäftsordnung für die Bezirkshauptmannschaften in Niederösterreich, Wien 1928, Beilage 1, Geschäftsplan für die Bezirkshauptmannschaften in Niederösterreich. Ab 1926 war ein neuer Geschäftsplan wirksam. Er wies zahlreiche Ähnlichkeiten mit seinem Vorgänger auf, umfasste aber nur mehr 13 Gruppen und 208 Abschnitte:

Bestandsgeschichte:
Der Bestand wurde 1961 und 1966 neu geordnet, und Teile davon wurden damals auch skartiert (NÖLA, Verzeichnis der Archivalien der BH Amstetten, Bericht von Oberarchivrat DDr. Felix Wintermayr im Juli 1966). Die restlichen Akten wurden 1989 übernommen und im Außendepot Bad Pirawarth aufgestellt (NÖLA, ANÖLR, L.A. III/3, A-13/3-89). 2009 wurden sie in das neu errichtete Kulturdepot St. Pölten West transferiert und mit den im selben Jahr aus der BH Amstetten geholten Büchern vereinigt.

Bestandsbeschreibung:
Der Bestand lässt sich grob in fünf Teile gliedern und umfasst die Jahre 1870 bis 1955. Der erste Teil erstreckt sich von 1870 bis 1906. Er enthält überwiegend thematisch unerschlossene Akten sowie zwei Kartons Eisenbahnangelegenheiten. Verzeichnisse existieren für diese Akten nicht; bei der Recherche müssen die einzelnen Kartons durchgearbeitet werden.
Der zweite Teil umfasst die Jahre 1907 bis 1955 und ist durch Eingangs- und Nachschlagebücher gut erschlossen. Die Periode des Nationalsozialismus ist ungewöhnlich gut dokumentiert. Die Akten sind chronologisch und nach Sachgruppen und Abschnitten gemäß den oben beschriebenen Geschäftsplänen geordnet.
Der dritte Teil des Bestandes betrifft Angelegenheiten der "Abwicklung" des NS-Regimes. Er enthält umfangreiche Agenden der Vermögenssicherung und der Registrierung von NationalsozialistInnen, ist aber nur unzureichend durch Bücher erschlossen.
Der vierte Teil umfasst Mündelakten der Jugendfürsorge im Bezirk Amstetten. Er umspannt die Jahrgänge 1938 bis 1955. Da keine Verzeichnisse existieren, ist eine Orientierung in diesem Teilbestand außerordentlich erschwert.
Der fünfte Teil ist ein Varia-Bestand. Er enthält also Akten unterschiedlicher Angelegenheiten; sie reichen von Bau-, Naturschutz-, Wasserbuch- und Armenfürsorgesachen bis hin zu Agenden der Bezirksforstinspektion Waidhofen an der Ybbs.
Gewerbeakten sind abgesehen ganz wenigen Ausnahmen in dem Bestand nicht enthalten. Dagegen stehen die Gewerbe-Kataster von 1860 bis 1938 - allerdings mit Lücken - zur Verfügung.

  • Only descriptive dates provides the date information in human-readable format.
  • No date either includes documents where the creation date is unknown, or where date information is not in a machine-readable format
