Le fonctionnement du cabinet des ministres est régi par le décret n° 48-1233 du 28 juillet 1948 modifié portant règlement d’administration publique en ce qui concerne les cabinets ministériels. Il est constitué par le ministre lors de sa prise de fonction et est composé :

d’un directeur (assisté parfois d’un directeur adjoint), chargé de la coordination entre le ministre et son administration ;

d’un chef de cabinet dont le rôle est de veiller au bon fonctionnement du cabinet : agenda du ministre, déplacements, secrétariat, audiences et relations publiques, distinctions honorifiques ;

de conseillers chargés d’un ou plusieurs dossiers et devant assurer le suivi de l’activité des directions et de chargés de mission aux attributions ponctuelles. Le décret n° 2017-1063 du 18 mai 2017 relatif aux cabinets ministériels (NOR : PREX1714723D) limite le nombre de conseillers à 10 membres.

HISTORICAL NOTE

Historical note:

Franck Riester est nommé ministre de la Culture le 16 octobre 2018, sous la présidence d'Emmanuel Macron, dans le deuxième gouvernement d'Edouard Philippe (juin 2017 à juillet 2020). Il succède à Françoise Nyssen.

Son mandat est marqué par l’incendie de la cathédrale Notre-Dame de Paris le 15 avril 2019 qui éclipse les célébrations de l’anniversaire des 60 ans du ministère (1959-2019), puis par la pandémie de la Covid-19 à partir de mars 2020.

Ses actions s’inscrivent au sein de quatre axes prioritaires : l’émancipation du citoyen par l’art et la culture, le soutien aux filières de la création, le renforcement de la culture au sein des territoires afin qu’elle soit un levier de cohésion et d’attractivité, et la défense de la souveraineté culturelle de notre pays (Source : discours pour l’anniversaire des 60 ans du ministère de la Culture, 24 juillet 2019, https://www.culture.gouv.fr/Actualites/Franck-Riester-Les-ambitions-de-la-politique-culturelle). A ce titre, sa politique s’inscrit dans la continuité des projets lancés sous le mandat de sa prédécesseur Françoise Nyssen (développement du pass Culture et des Micro-Folies, réforme du portage de la presse et réforme de l’audiovisuel).

L’intensification de l’éducation artistique et culturelle constitue un engagement du quinquennat d’Emmanuel Macron. Une des actions phares est la mise en œuvre du pass Culture. Initié sous le mandat de Françoise Nyssen, ce dispositif est officiellement lancé en février 2019 avec une première expérimentation auprès de 5 départements : le Bas-Rhin, l’Hérault, le Finistère, la Guyane et la Seine-Saint-Denis. Il vise à faciliter l’accès à la culture en offrant 500 euros à chaque jeune de 18 ans pour accéder à une offre culturelle référencée via à une application numérique (achats d’œuvres et services culturels).

En juin 2019, l’expérimentation est élargie à 9 autres départements, et, en juillet, le dispositif est réorganisé avec la mise en place d’une société par actions simplifiées (SAS) chargée d’assurer sa gestion et son développement.

En août 2019, a lieu la remise officielle du rapport « Culture-Enfance-Parentalité » de Sophie Marinopoulos, chargée par Françoise Nyssen d’une mission sur l’éveil artistique et culturel des jeunes enfants. Il contient une proposition de plan d’action pour mettre la culture au cœur de l'accompagnement du lien parent/enfant.

Afin d’améliorer le soutien aux filières de la création et d’adapter les politiques publiques existantes en faveur des artistes, auteurs et créateurs, le ministre confie une mission d’étude sur les évolutions des activités de la création à Bruno Racine, conseiller maître à la Cour des comptes, en avril 2019. En janvier 2020 est remis le rapport « L’auteur et l’acte de création ». A sa suite, le ministre annonce en février 2020 un plan d’action en faveur des artistes auteurs. Ce plan prévoit d’améliorer leurs droits sociaux, notamment en simplifiant les régimes de protection sociale, ainsi que leur situation économique, notamment grâce à une répartition plus juste du partage de la rémunération entre les créateurs et les diffuseurs ainsi que le renforcement des soutiens directs de l’État, et de définir de nouvelles instances de représentation, avec la création d’une nouvelle instance transversale pour le dialogue social.

Le développement des Micro-Folies est au cœur de la politique en faveur de l’attractivité des territoires. Ce dispositif culturel innovant à destination des territoires, lancé sous le mandat de Françoise Nyssen, a pour ambition de « rendre accessible la culture au plus grand nombre » (Franck Riester) et d’être un outil d’éducation artistique et culturelle. Il consiste à installer un musée numérique au cœur d’un équipement déjà existant. Celui-ci peut être accompagné d’un FabLab, d’une médiathèque, d’une scène, d’un espace de convivialité… En 2019, 35 Micro-Folies sont recensées sur le territoire, avec pour objectif d’atteindre les 1 000 Micro-Folies à l’horizon 2022.

La volonté de renforcer les partenariats avec les collectivités structure également la création de nouveaux établissements tels que la cité internationale de la Francophonie à Villers-Cotterêt ou celle de l’établissement public industriel et commercial du Mont-Saint-Michel (décembre 2019) qui est chargé d’assurer la gestion unifiée et le développement du site, en lien avec le ministère de la Transition écologique et solidaire, les collectivités territoriales et les différents acteurs économiques.

La déconcentration en janvier 2020 d’une soixantaine de dispositifs auprès des directions régionales des affaires culturelles (DRAC) a pour objectif d’adapter les politiques culturelles aux spécificités des territoires.

Dans le domaine du patrimoine, l’incendie de la cathédrale Notre-Dame de Paris provoque un élan de solidarité mais aussi une importante polémique au sujet de l’entretien du patrimoine bâti. Pour répondre aux critiques, le budget alloué en 2020 à la restauration et à l’entretien des monuments historiques sera augmenté de 7 millions d’euros pour atteindre 338 millions d’euros. La restauration de Notre-Dame constitue un engagement majeur du président Emmanuel Macron. Un établissement public spécifique est créé en novembre 2019 afin de piloter le chantier. En outre, le plan d’action « Sécurité cathédrales » destiné à renforcer la sécurité des 87 cathédrales appartenant à l’État est doté de 2 millions d’euros.

Par ailleurs, le loto du patrimoine, mis en place sous le patronage de Stéphane Bern, prend une nouvelle ampleur suite au succès de la première édition de septembre 2018. Créé par la Française des jeux, ce jeu de loto est destiné à récolter des fonds pour la Fondation du patrimoine afin d’assurer la restauration de monuments considérés comme étant en péril, qu'il s'agisse de monuments historiques ou non. L’opération est reconduite pour sa seconde édition en 2019, avec la mise en place d’un tirage exceptionnel du loto le 14 juillet.

Enfin, l’accès à la Culture sur le territoire se concrétise également par la distribution de la presse. La distribution de la presse vendue au numéro est régie, en France, par les dispositions de la loi Bichet du 2 avril 1947 modifiée relative au statut des entreprises de groupage et de distribution des journaux et publications périodiques. Les difficultés rencontrées depuis 2017 par la société Presstalis, première messagerie de presse en France, remettent en cause ce modèle économique. Celle-ci dépose le bilan en 2020. Son sauvetage est rendu possible grâce à la collaboration des éditeurs de la filière et à la contribution de l’État à hauteur de 80 millions d’euros à la restructuration et au plan social du distributeur qui devient France Messagerie. En parallèle, un projet de loi est déposé afin de réformer la loi Bichet : la loi du 18 octobre 2019 relative à la modernisation de la distribution de la presse prévoit notamment d’ouvrir le secteur à de nouveaux acteurs à l’horizon 2023 et confie la régulation du secteur à l’Autorité de régulation des communications électroniques et des postes (ARCEP).

Le dernier axe de la politique culturelle du ministre Franck Riester, la réaffirmation de la souveraineté culturelle, est au cœur du projet de loi audiovisuelle présenté en décembre 2019 par le ministre. Le projet de loi relatif à la communication audiovisuelle et à la souveraineté culturelle à l’ère numérique vise à adapter notre modèle aux nouveaux enjeux et usages, notamment du numérique. Il comprend 3 volets : « l’intégration de l’ensemble des diffuseurs au système de financement de la création, quel que soit leur lieu d’installation » ; le renforcement de « la protection des publics contre les contenus nocifs ou illicites », notamment avec la création d’une nouvelle autorité de régulation de la communication audiovisuelle et numérique (l’ARCOM, issue de la fusion du Conseil Supérieur de l’Audiovisuel et de la Haute Autorité pour la Diffusion des Œuvres et la Protection des droits sur Internet) chargée de « veiller au respect des nouvelles dispositions visant à responsabiliser les plateformes et à favoriser l’accès à des programmes audiovisuels de qualité, diversifiés et pluralistes » ; la réforme de la gouvernance de l’audiovisuel public avec la création d’une société mère, France Médias, destinée à regrouper France Télévisions, Radio France, France Médias Monde et l’INA, afin de « définir une stratégie globale adaptée à la convergence numérique et à la concurrence des nouveaux acteurs, notamment internationaux » (Source : Assemblée nationale, Projet de loi nº 2488 relatif à la communication audiovisuelle et à la souveraineté culturelle à l'ère numérique). Ce dernier volet n’est pas mis en œuvre sous le mandat du ministre.

La pandémie de la Covid-19 à partir de 2020 affecte profondément le monde de la Culture notamment avec la mise en place du confinement en mars 2020. L’enquête sur les effets de la crise sanitaire menée par le Département des Études, de la prospective, des statistiques et de la documentation (DEPS) du ministère de la Culture auprès de professionnels de la Culture évalue les pertes à 22,3 milliards d’euros, soit une baisse globale de 25% du chiffre d’affaires du secteur par rapport à 2019 (Source : Crise sanitaire dans le secteur culturel–Impact de la pandémie de Covid-19 et des mesures de soutien sur l’activité et la situation financière des entreprises culturelles en 2020, par Julien Giorgi et Suzanne Scott. Étude publiée par le Département des Études, de la prospective, des statistiques et de la documentation (DEPS) du ministère de la Culture, 2022, 38 pages). Pour soutenir les différents secteurs culturels et leurs acteurs face à cette crise sans précédent, le gouvernement a au total, en juillet 2020, mobilisé 5 milliards d'euros.

Le 3 juillet 2020, à la suite du second tour des élections municipales, Édouard Philippe présente la démission de son gouvernement. A l’issu du remaniement, Franck Riester est nommé ministre délégué chargé du commerce extérieur et de l’attractivité au sein du nouveau gouvernement constitué par Jean Castex.
