D’après l’article 4 du 5 janvier 1998, le CND est doté d’un conseil d’administration, d’un comité artistique et d’un directeur général. Le conseil d’administration est composé de la façon suivante ;

« – le directeur de la musique et de la danse, le directeur de l’administration générale et le délégué à la danse au ministère chargé de la culture, ou leurs représentants ;

– le président de l’Établissement public du parc et de la grande halle de La Villette, ou son représentant ;

– le directeur général de la Cité de la musique, ou son représentant ;

– le directeur du Conservatoire national supérieur de musique et de danse de Paris, ou son représentant ;

– le maire de la ville de Pantin, ou son représentant ;

– Quatre personnalités qualifiées, nommées par arrêté du ministre chargé de la culture pour une durée de trois ans renouvelable.

– Deux représentants élus des salariés pour une durée de trois ans renouvelable. »

Le conseil d’administration délibère notamment sur les orientations ainsi que les mesures générales relatives à l’organisation et au fonctionnement de l’établissement ; l’état annuel des prévisions de recettes et de dépenses et ses modifications ; les orientations artistiques et pédagogiques de l’établissement ainsi que le programme d’activité du centre ; la programmation des manifestations artistiques ou culturelles, des activités de formation professionnelle ainsi que des expositions ; les orientations générales de la politique d’acquisition des œuvres et objets destinés à prendre place dans les collections nationales dont il a la garde.

Le directeur général est nommé par décret sur proposition du ministre chargé de la culture, après avis du président du conseil d’administration, pour une durée de trois ans renouvelable. Ses compétences sont définies ainsi :

« Art. 12. – Le directeur général :

– Prépare le programme d’activités et en assure le bon déroulement ;

– Prépare l’état des prévisions de recettes et de dépenses de l’établissement public ainsi que les décisions modificatives et veille à leur exécution ;

– Prépare les délibérations du conseil d’administration et en assure l’exécution ;

– À autorité sur les services de l’établissement dont il prépare le règlement intérieur ;

– Est ordonnateur des recettes et dépenses ;

– Prépare et signe les accords d’entreprise et veille à leur application ;

– Assure la gestion de l’établissement, engage et gère l’ensemble des personnels permanents et occasionnels de l’établissement, sur proposition des directeurs placés sous son autorité, chacun pour ce qui le concerne ;

– Passe tous actes, contrats ou marchés ;

– Représente l’établissement en justice et dans tous les actes de la vie civile.

Pour l’exercice de ses attributions, il peut déléguer sa signature aux directeurs et chefs de service placés sous son autorité. »

HISTORICAL NOTE

Historical note:

La création du CND (1991-1998)

Le Centre national de la Danse (CND) est institué par le décret du 5 janvier 1998. Sa création se situe dans un contexte de réforme de l’organisation de l’administration territoriale qui prévoit notamment, par la loi du 6 février 1992, un rééquilibrage des activités publiques sur le territoire métropolitain. Ainsi le CND répond à la volonté de la Mission pour l’implantation territoriale des emplois publics et du Comité Interministériels d’aménagement et de développement du territoire (CIADT), de créer des organismes publics dans les grandes villes afin de conforter leur pôle de compétences. L’établissement de ce lieu permet également de rationaliser et de clarifier l’action de l’État, en réunissant au sein d’une même entité juridique des activités qui dépendaient jusqu’à présent de plusieurs associations, ainsi que certaines activités développées au sein d’autres institutions. En effet le CND regroupe les activités et les moyens de quatre structures déjà existantes : le Théâtre contemporain de la danse (TCD), l’Institut de formation des enseignants de la musique et de la danse de Paris (IFEDEM), le secteur chorégraphique de la Cité de la musique et la partie consacrée à la danse du Centre de formation des enseignants de la musique et de la danse (CEFEDEM) de Lyon. En 2013, les activités de la Cinémathèque de la danse fusionneront également avec le CND. Le projet du CND prévoit alors un siège à Pantin, sur les bords du canal de l’Ourcq, dans les locaux de l’ancienne cité administrative de la ville et une antenne permanente à Lyon.

La création du CND relève également d’une volonté politique et de la profession, de mettre en place de nouveaux moyens de soutien pour le développement de la mémoire chorégraphique et de sa transmission (comme cela a été le cas pour l’enseignement, la création et la diffusion de la danse dans les années 1970 et 1980). Un document produit par le CND, daté du 3 juin 2002, évoque le rapport produit par le Conseil Supérieur de la Danse (CSD) en 1991 sur le patrimoine chorégraphique en France, qui se présente comme un des éléments déclencheur de la nécessité d’un lieu consacré à tous les aspects de l’art chorégraphique. En effet ce rapport pose le constat d’une culture chorégraphique dense et diversifiée, mais peu mise en valeur. Un second argument en faveur de la mise en place d’un centre national pour la danse est la mise en place de la loi du 10 juillet 1989 relative au diplôme d’État de professeur de danse. Ce diplôme est organisé en cinq unités de valeur dont une « Histoire de la danse ». Lors de l’élaboration des contenus de cette unité de valeur, la profession s’est rendu compte du manque de connaissances, de réflexions et de recherches sur l’histoire d’un art dans lequel « la France se place au premier plan ». La combinaison de ces deux événements produit de grandes préoccupations sur la conservation, la réflexion et la transmission des œuvres, accentuées par la disparition d’artistes d’envergure tels que Rudolf Noureev en 1993 et Dominique Bagouet en 1992.

Ainsi la délégation à la danse et le département des études et prospectives du ministère de la Culture, ont mené une étude entre 1993 et 1995 auprès des professionnels et des publics afin de dégager des lignes de forces pour construire le projet d’un établissement public dédié à la danse. D’après ce même document le CND est « un espace bâti qui soit exclusivement consacré à la danse dans toutes ses diversités esthétiques, géographiques, historiques ou sociales ; lieu de rassemblement et de production d’outils permettant le développement d’une culture chorégraphique vivante. La nouvelle institution définie, devrait également s’inscrire dans l’activité chorégraphique foisonnante de ses différents métiers dans les domaines de la création, de la diffusion comme de la pédagogie. ».

Le CND est inauguré le 18 juin 2004.

L’organisation et les missions du CND depuis 1998

Le CND est un établissement public à caractère industriel et commercial, sous la tutelle du ministre de la Culture, il est donc soumis au contrôle économique et financier de l’État par le décret du 5 mai 2000. Les missions et compétences du CND sont écrites à l’article 2 du décret portant sur sa création :

« Art. 2. – Le Centre national de la danse a pour mission d’entreprendre des activités consacrées au développement de la culture et de l’art chorégraphique. Il assure la formation de danseurs professionnels au métier de professeur de danse, participe à la formation professionnelle continue des enseignants et des artistes chorégraphiques, facilite leur insertion dans la vie professionnelle. Il favorise l’essor de la création et de la diffusion d’œuvres chorégraphiques ; il met en œuvre une programmation permettant la production, la coproduction ou l’accueil de spectacles, en partenariat avec les organismes qui contribuent à la réalisation de ces missions ; il s’efforce en particulier d’élargir le public des spectacles de danse. Il contribue à l’information et à la formation chorégraphiques du public et des professionnels. Il participe au développement de la recherche dans le domaine de la danse. Il contribue à la conservation du patrimoine chorégraphique et assure la conservation, l’étude, l’enrichissement, la présentation au public et la mise en valeur des collections publiques ou privées dont il a la garde. ».

L’article 3 précise les modalités d’actions de l’établissement :

« Art. 3. – Pour l’accomplissement de ses missions, le Centre national de la danse peut notamment :

– Accueillir et susciter toutes activités et initiatives, notamment dans les domaines de l’organisation de manifestations chorégraphiques, de la formation et de la recherche ;

– Réaliser et commercialiser, directement ou indirectement, tout produit ou service lié à ses missions de diffusion, de formation et de recherche ;

– Coopérer avec les collectivités territoriales ainsi que les organismes, fondations et associations, français ou étrangers, poursuivant des objectifs répondant à sa vocation ; le centre peut également prendre des participations dans le capital de sociétés poursuivant des objectifs similaires. »

La composition du comité artistique s’est faite dans un premier temps par la nomination de son président. Ainsi par l’arrêté du 18 août 1998, Maurice Béjart est nommé directeur artistique du CND. C’est près de 3 ans plus tard que l’arrêté du 27 août 2001 portant sur la nomination des membres du comité artistique complète son effectif. L’article 13 du décret du 5 janvier 1998 nomme ses missions et son fonctionnement :

« Art. 13. – Un comité artistique donne des avis sur les orientations artistiques et pédagogiques de l’établissement et évalue la réalisation de ses différentes activités.

Le président du comité artistique est nommé par arrêté du ministre chargé de la culture, après avis du président du conseil d’administration, pour une durée de trois ans renouvelable.

La composition et les modalités de fonctionnement de ce comité sont fixées par le conseil d’administration. »

Le CND, pour répondre à ses ambitions, comprend quatre départements :

– l’institut de pédagogie et de recherche chorégraphique, qui a pour but de former les danseurs professionnels en exercice qui souhaitent devenir enseignants de la danse et de former les formateurs de formateurs qui exercent dans le secteur public ou privé, en préparant au diplôme d’État de professeur de danse. Ce département participe également à la formation continue des artistes chorégraphiques (mis en place de stages et de séminaires de réflexions).

– le département des métiers, qui engage des actions et des réflexions sur les statuts professionnels des artistes, en partenariat avec les organismes sociaux et de formation ainsi que les universités et les institutions publiques.

– une médiathèque dont l’objectif est la constitution d’un vaste fonds documentaire à destinations des professionnels et des amateurs. Elle participe à la conservation des supports de la « mémoire de la danse » et des œuvres par un travail étroit avec les compagnies et contribue également à la stimulation de la recherche en lien avec les universités, par l’édition d’ouvrages et la mise en place d’expositions.

– une « maison des compagnies », qui accueille les danseurs professionnels en exercice via le dispositif des accueil-studio et de résidences. Elle soutient également la création et la diffusion par la mise en place de coproductions et de rencontres professionnelles.

L’arrêté du 23 décembre 2002, habilite le Centre national de la Danse à délivrer le certificat d’aptitude aux fonctions de professeur de danse dans les écoles territoriales de musique, danse et art dramatique, à l’issue d’une formation diplômante.

L’établissement est soumis à un contrat d’objectifs avec l’État mentionné à l’article 15 du décret. Ce contrat, qui est pluriannuel, est établi à partir des missions qui sont imparties au CND et le budget de fonctionnement qui lui est alloué. Les négociations pour la fixation du contrat ont duré 2 ans, pour aboutir à un accord lors de la réunion du conseil d’administration le 29 juin 2000. Les négociations portent notamment sur la construction d’un théâtre de 500 places au sein de l’établissement pour affirmer sa compétence de développement des publics et de la création.

Le décret du 22 mars 2012 actualise les statuts du CND en précisant ses missions. La notice du décret précise que ce dernier « modifie la composition et la compétence du conseil d’administration. Il confie à l’établissement le soin d’attribuer les subventions et aides financières dans le domaine de la recherche, du patrimoine et de la pratique de la danse en amateur, compétence jusqu’ici exercée par la direction générale de la création artistique du ministère chargé de la culture. ».
