STRUCTURE

Note:

En vertu du décret du 2 octobre 1789, le comité des Domaines est constitué d’un député par généralité. Il est initialement composé de Banyuls de Montferré, Baron, Barrère de Vieuzac, Bengy de Puyvallée, Bévière, de Bonnegens, Buschey-Desnoes, Christin, Colonna de Cesari Rocca, Delattre de Batzaert, Deschamps (de Lyon), Dutrou de Bornier, Enjubault de La Roche, Fleurye (député de Caux), Fricot, Gaultier-Biauzat, Geoffroy, Gontier de Biran, Gouy d’Arsy, Gros (de Boulogne-sur-Mer), Hennet, Le Bois des Guays, Le Goazre de Kervélégan, Lombard de Tarradeau, Manhiaval, Parent de Chassy, Pfliéger, Pison du Galand, Pouilly (remplacé par Roger le 5 juin 1790), Pouret-Roquerie, Roy et De Vismes.

Le comité est réduit à 24 membres sous la Législative et se compose, selon les résultats du scrutin du 27 octobre 1791, des députés suivants : André (du Thillot), Baumlin, Benoiston, Bonnerot, Chéron-La-Bruyère, Crestin, Croichet, Cunin, Dalibourg, Ducreux, Durin, Duvant, Gelot, Goujon, Juéry, Lebœuf, Leboucher-du-Longchamp, Levasseur aîné, Pierret, Piorry, Rabusson-Lamothe, Léonard Robin, Torné et Vincens-Plauchut.

Sous la Convention, le comité des Domaines est réduit à 12 membres.

Les procès-verbaux des séances du comité, s’ils ont existé, ne nous sont pas parvenus et l’on ne dispose que très peu de documents relatifs à l’organisation interne de ce comité, dont le fonctionnement demeure donc opaque.

On sait toutefois, grâce à l’un des inventaires dressés au moment du dépôt, aux Archives, des papiers et des ouvrages du comité à la fin de la Constituante, quelle était la composition de sa bibliothèque de travail (« Comité des Domaines. Supplément de l’inventaire : état des volumes qui ont été successivement remis au comité des Domaines et qui ont été déposés aux Archives de l’Assemblée nationale le 30 septembre 1791 ; AB/Vc/2, d. 23) :

« - 9 cartons in-4° en forme de livres, contenant des extraits des dires des différents inspecteurs des domaines, lesquels ont été remis par M. Dutremblai qui avait été chargé d’un travail sur les domaines.

- 1 volume in-4° manuscrit, contenant les échanges faits avec le Roi depuis 1667 jusqu’en 1786. Ce volume remis par ..., premier commis des Finances

- 1 volume in-4° d’un ouvrage intituléEssai sur les apanages, remis par M. de Roi, ci-devant secrétaire des Eaux et Forêts du département de Paris.

- 1 volume in-8° d’un traité sur les réformations et les aménagements des forêts par M. Plinguet.

- 1 volume in-4° intituléCode de l’hôpital de Paris.

- 1 petit in-folio intituléFixation des offices des apanages de Monsieur.

- 1 petit in-folio relié en bleu intituléÉtat général des forêts du domaine, remis par M. de Lessart.

- 1 volume in-folio du procès-verbal d’évaluation de la principauté de Dombes, relié en basane, remis par M. Perrier, chef du Conseil de la Maison de Penthièvre.

- 1 volume en parchemin contenant l’état des domaines corporels et incorporels de Bourbonnois, remis par M. Mars.

- 1 volume in-folio manuscrit intitulé « Toisé de l’hôtel St-Florentin », remis par M. Vienne, ingénieur, rue de la Grande Truanderie.

- 2 volumes reliés en parchemin, intitulés « Compte rendu par M. le baron de Lovendeghon, receveur du Domaine de Gand, à M. Roger, directeur des fermes de Lille ».

- 2 volumes in-4° reliés d’un mémoire et observations de M. le procureur général de la chambre des comptes du Dauphiné sur la concession de la plaine anciennement forêt de Bièvre.

- 1 volume relié duCode de l’administration de l’aliénation des biens nationaux.

- 15 volumes reliés de laCollection générale des décrets.

- 1 volume intituléRequête de l’échange de Sancerre.

- 1 plan de la ferme de Maison-Ville.

- 2 almanachs royaux des années 1790 et 1791 ».

Ces ouvrages (à l’exception des 15 volumes de la collection des décrets remis par erreur à un autre comité) ont été restitués par l’archiviste au comité des Domaines de la Législative le 14 novembre 1791.

HISTORICAL NOTE

Historical note:

Le comité des Domaines est établi par un décret de l’Assemblée nationale constituante du 2 octobre 1789, en vertu duquel il est chargé de la recherche et de l’examen « de tous les engagements, échanges, concessions et aliénations quelconques de biens et domaines de la Couronne, et spécialement du comté de Sancerre ». Dans un premier temps, il n’est question que du domaine de la Couronne : constitué en « domaine national », il est composé de « toutes les propriétés foncières et de tous les droits réels ou mixtes qui appartiennent à la nation » (décret du 22 novembre 1790 sur la législation domaniale). Cela inclut non seulement le « domaine public », mais aussi les biens ecclésiastiques, mis à la disposition de la nation par le décret du 2 novembre 1789 et, dès lors, intégrés aux « domaines nationaux ».

Malgré les besoins considérables du Trésor public, tous les biens et domaines nationaux ne sont pas déclarés aliénables : sont notamment exclus des ventes les « forêts et maisons royales dont Sa Majesté voudra se réserver la jouissance » (décret du 19 décembre 1789, art. 2). Les domaines nationaux ne peuvent être aliénés qu’en vertu d’un décret formel du Corps législatif sanctionné par le Roi (décret du 22 novembre, qui confirme notamment l’inaliénabilité des bois et forêts).

Compte tenu de la composition du domaine national, le comité des Domaines est amené à collaborer fréquemment avec le comité Ecclésiastique. À la fin du mois de janvier 1790, l’Assemblée nationale leur demande de présenter, en commun, l’état des domaines pouvant être aliénés dès la mise en activité des administrations départementales.

Il importe de distinguer aliénabilité et aliénation des domaines nationaux. La première renvoie au statut juridique d’un bien et relève des compétences du comité des Domaines ; la seconde correspond à l’acte de transfert de propriété, suivant une procédure spécifique, et relève des attributions du comité d’Aliénation. L’aliénabilité est naturellement une condition sine qua non de l’aliénation. Le comité des Domaines se doit donc de tenir à jour l’état général des domaines nationaux et de connaître précisément tous les revenus et charges qui leur sont afférents. Dans ce but, le décret du 22 novembre 1790 (art. XXXIV) enjoint « à tous concessionnaires et détenteurs des biens domaniaux, à quelque titre qu’ils en jouissent, de présenter au comité des Domaines de l’Assemblée nationale et au directoire du département de la situation du chef-lieu de ces domaines, dans trois mois, à compter du jour de la publication du présent décret, des copies sur papier libre, collationnées par un officier public, des titres de leurs acquisitions, des procès-verbaux qui ont dû précéder l’entrée en jouissance, des quittances de finances, si aucunes ont été payées ; des baux qui en auront été consentis et en général de tous les actes, titres et renseignements qui pourront en constater la consistance, la valeur et le produit, et faire connaître le montant des charges dont ils sont grevés ; et faute par eux d’y satisfaire dans le délai prescrit, ils seront condamnés à la restitution des fruits, du jour qu’ils seront en demeure ». Les dossiers de pièces justificatives constitués au comité des Domaines lui permettent de présenter à l’Assemblée des rapports sur le produit des domaines nationaux et sur les dépenses nécessaires à leur entretien (cf., par exemple, le décret du 2 juin 1791).

D’après l’inventaire des registres et des cartons remis par le comité aux archives de l’Assemblée nationale en septembre 1791 (cf. AB/Vc/2, dossier 23), il a été chargé d’examiner les questions les plus diverses : mines, forges, canaux, salines, pêcheries, ponts et chaussées, chasses, baux et droits domaniaux, domaines engagés, etc. Enfin, il lui revient également d’organiser les services administratifs départementaux responsables de la gestion des biens et domaines nationaux, en particulier des eaux et forêts.

Conservé sous la Législative (décret du 14 octobre 1791), le comité des Domaines fusionne avec celui d’Aliénation sous la Convention (décret du 2 brumaire an II - 23 octobre 1793), avant la réorganisation générale des comités de l’Assemblée (décret du 7 fructidor an II).
