Ordonnance du 15 août 1815 qui établit une commission de l’instruction publique.
Notre ordonnance du 17 février n’ayant pu être mise à exécution, et les difficultés des temps ne permettant pas qu’il soit pourvu aux dépenses de l’instruction publique ainsi qu’il avait été statué par notre ordonnance susdite ;
Voulant surseoir à toute innovation importante dans le régime de l’instruction jusqu’au moment où des circonstances plus heureuses, que nous espérons n’être pas éloignées, nous permettront d’établir, par une loi, les bases d’un système définitif,
Nous avons ordonné et ordonnons ce qui suit :
ARTICLE PREMIER. — L’organisation des académies est provisoirement maintenue.
ART. 2. — La taxe du vingtième des frais d’études, établie par le décret du 17 mars 1808, continuera d’être perçue, à dater du 7 juillet dernier, jusqu’à ce qu’il en ait été autrement ordonné. Le recouvrement de l’arriéré dû le 17 février dernier sera poursuivi conformément aux décrets et règlements.
ART. 3. — Les pouvoirs attribués au grand-maître et au Conseil de l’Université, ainsi qu’au chancelier et au Trésorier, seront exercés, sous l’autorité de notre ministre secrétaire d’État au département de l’intérieur, par une Commission de cinq membres, laquelle prendra le titre de Commission de l’instruction publique.
ART. 4. — Elle régira les biens et percevra les droits, rentes et revenus qui formaient la dotation de l’Université.
ART. 5. — La présence de trois membres, au moins, sera nécessaire pour la validité de ses actes.
ART. 6. — Le président de la Commission délivrera les diplômes, et ordonnera les traitements et pensions, conformément aux états arrêtés par la Commission.
ART 7. — Les dénommés en notre ordonnance du 21 février dernier rempliront les fonctions d’inspecteurs généraux des études.
ART. 8. — Nous avons nommé et nommons membres de la Commission de l’instruction publique :

Cuvier, conseiller d’État, et conseiller au Conseil royal de l’instruction publique ;
Le baron Silvestre de Sacy, membre de l’Institut, professeur au Collège royal de France, recteur de l’université de Paris ;
L’abbé Frayssinous, inspecteur général des études ;
Guéneau de Mussy, ancien inspecteur général des études.
Le sieur Petitot, inspecteur de l’Université de Paris, est nommé secrétaire général de la dite commission.
ART. 9. — Le sieur Ampère est nommé inspecteur général des études, en remplacement de l’abbé Frayssinous, nommé membre de la Commission de l’instruction publique.
ART. 10. — Notre garde des sceaux, ministre secrétaire d’État au département de la justice, ayant par intérim le portefeuille de l’intérieur, est chargé de l’exécution des présentes.

Le 15 août 1815, une ordonnance royale transfère les attributions du Conseil de l’Université à un nouvel organe appelé « Commission de l’instruction publique », placé sous l’autorité du ministre de l’Intérieur. Les pouvoirs attribués au grand-maître et à l’ancien Conseil de l’Université, sont donc exercés sous son autorité. L’effectif des conseillers est considérablement revu à la baisse puisqu’il passe de trente à cinq.
En 1817, Royer Collard, président de la Commission rappelle la tutelle considérable que l’État exerce sur celle-ci en ces termes : « L’Université n’est autre chose que le gouvernement appliqué à la direction universelle de l’instruction publique. Elle a été élevée sur cette base fondamentale que l’instruction et l’éducation publiques appartiennent à l’État et sont sous la direction supérieure du Roi… » (GREVET René, L’avènement de l’école contemporaine en France (1789-183) : laïcisation et confessionalisation de la culture scolaire, Presses universitaires du Septentrion, Villeneuve d’Ascq, 2001, p. 89).
Le 1er novembre 1820, une nouvelle ordonnance transforme la Commission en « Conseil royal de l’instruction publique ».
