Caisse de retraites des personnels de l'Opéra national de Paris
Décret du 14 mai 1856
Décret du 28 février 1923 reconnaissant la Caisse de retraite du personnel du théâtre national de l'Opéra comme établissement d'utilité publique.

Décret n°80-822 du 16 octobre 1980 fusionnant sous le titre de Caisse de retraite du théâtre national de l'opéra de Paris, les caisses de retraite des personnels de l'opéra et de l'opéra-comique.

Le régime de retraite des personnels de l'Opéra national de Paris est géré par un conseil d’administration composé de 12 membres :
- 2 membres du Conseil d’Etat nommés par arrêté interministériel : Président et Vice-président
- 2 membres de droit disposant chacun de trois voix et représentant l’Opéra de Paris et le ministre chargé de la culture
- 6 membres élus représentant les diverses catégories des personnels de l’Opéra national de Paris.
- 2 membres avec voix consultative représentant les retraites désignés par l’association la plus représentative des retraités de l’Opéra et de l’Opéra-Comique.
2 commissaires du gouvernement représentant les ministres chargés de la sécurité sociale et du budget assistent au Conseil d’administration. Leur voix est consultative.
Les membres nommés et élus du conseil d’administration ont un mandat de 3 ans renouvelable.
Le Conseil d’administration a une compétence de droit commun pour :
- prendre toute décision en matière de gestion technique, administrative et financière,
- voter le budget annuel,
- approuver par exercice le compte financier,
- définir la politique de la Caisse de retraites en matière d’action sociale.
- donner son avis sur les projets de textes concernant le régime.
Trois commissions spécifiques ont été constituées par délégation du Conseil d’administration. Elles sont chargées respectivement d’examiner et de statuer sur :
- les demandes de mise à la retraite pour invalidité,
- les recours amiables contre les décisions de la Caisse de retraites,
- l’attribution des marchés publics.
Les décisions du Conseil d’administration sont exécutoires sauf annulation par les autorités ministérielles de tutelle (ministères chargés du budget et de la sécurité sociale) dans le délai d’un mois à compter de leur communication.
La Caisse de retraites, comme les autres organismes de sécurité sociale, est soumise au contrôle :
- des autorités compétentes de l’État
- de la Cour des Comptes
- de la mission de contrôle économique et financier créée par l’arrêté du 11 mars 1998.
En outre, depuis 2009, les comptes de la Caisse de retraites sont soumis à l’avis d’un commissaire aux comptes avant leur approbation par le conseil d’administration.
Le directeur de la Caisse et son équipe assurent la gestion du régime.
Un agent comptable a la responsabilité financière des opérations comptables.
L’assistante sociale de l’Opéra prête son concours à la Caisse de retraites.
Parmi les régimes de sécurité sociale, l’un des plus anciens est celui des artistes de l’Opéra institué par Louis XIV en 1698. Un premier règlement avait en 1714 précisé les droits à pension des artistes. En 1856, une caisse de pensions viagères de l’Opéra a été créée pour tenir compte des spécificités des professions exercées au sein de l’Opéra et accorder aux assurés des droits particuliers en matière de retraite.
Le décret-loi du 28 octobre 1935 (article 23) et l’ordonnance du 4 octobre 1945 (article 17) ont confirmé parmi les régimes de sécurité sociale l’existence du régime spécial de l’Opéra. Ce dernier fonctionne actuellement en application des articles L.711.1 et R.711.1.10° du code de la sécurité sociale et d’un statut, fixé par le décret n°68-382 du 5 avril 1968 modifié.
La gestion de ce régime spécial est assurée par la Caisse de retraites des personnels de l’Opéra national de Paris depuis le décret n°80-822 du 16 octobre 1980. Ce décret a, en effet, entériné la fusion de la Caisse de retraites du personnel du théâtre national de l’Opéra avec celle du personnel de l'Opéra-Comique.
Etablissement d'utilité publique disposant d'une autonomie juridique et financière, la Caisse de retraites des personnels de l’Opéra a principalement pour objet :
d’affilier les personnels de l’Opéra national de Paris ressortant du champ d’application statutaire,
- de recouvrer les cotisations,
- de servir les prestations de retraites et d’invalidité aux personnels de l’Opéra,
- d’accorder les prestations d’action sociale aux affiliés, aux pensionnés, à leurs conjoints, et aux orphelins
de participer aux missions générales définies par le législateur et notamment à la mise en œuvre du droit à l’information prévue par la loi n° 2003-775 du 21 août 2003 et au fonctionnement du répertoire national des prestations sociales,
d’informer les ressortissants sur leurs droits et obligations (cotisations, estimation des retraites, reconstitution de carrière, validation de services, etc).
Le régime spécial de l'Opéra fonctionne selon le principe de la répartition. Les cotisations des actifs financent, pour partie, les retraites. Une subvention de l’Etat contribue ,par ailleurs, à l’équilibre financier de la Caisse et permet de garantir le paiement des retraites.
