Article 22
Il est créé un Conseil supérieur de l’éducation.
Ce conseil exerce les attributions dévolues antérieurement au Conseil supérieur de l’éducation nationale et au conseil de l’enseignement général et technique, à l’exclusion des attributions transférées au Conseil national de l’enseignement supérieur et de la recherche par l’article 23 de la présente loi. Il donne des avis sur les objectifs et le fonctionnement du service public de l’éducation.
Il est présidé par le ministre de l’éducation nationale ou son représentant et composé de représentants des enseignants, des enseignants-chercheurs, des autres personnels, des parents d’élèves, des étudiants, des collectivités territoriales, des associations périscolaires et familiales, des grands intérêts éducatifs, économiques, sociaux et culturels.
Les représentants des enseignants-chercheurs sont élus par les représentants des mêmes catégories élus au Conseil national de l’enseignement supérieur et de la recherche.
Les représentants des enseignants et des autres personnels sont désignés par le ministre de l’éducation nationale, proportionnellement aux résultats des élections professionnelles, sur proposition des organisations syndicales les plus représentatives du personnel ayant présenté des candidats à ces élections.
Les représentants des parents d’élèves sont désignés par le ministre de l’éducation nationale, sur proposition des associations de parents d’élèves proportionnellement aux résultats des élections aux conseils d’administration et aux conseils d’école.
Les représentants des étudiants sont désignés par le ministre de l’éducation nationale, sur proposition des associations d’étudiants proportionnellement aux résultats des élections au Conseil national de l’enseignement supérieur et de la recherche.
Le conseil comprend une section permanente et des formations spécialisées.
Le Conseil supérieur de l’éducation statuant en matière contentieuse et disciplinaire se compose de douze conseillers appartenant aux corps des enseignants, élus par leurs représentants à ce conseil.
Les membres représentant les établissements d’enseignement privés siégeant au Conseil supérieur de l’éducation élisent, pour la durée de leur mandat, six représentants qui siègent, avec voix délibérative, au conseil visé au précédent alinéa lorsque celui-ci est saisi d’affaires contentieuses et disciplinaires concernant ces établissements.
Le Conseil supérieur de l’éducation nationale et le conseil de l’enseignement général et technique sont maintenus en fonction jusqu’à la date d’installation du Conseil supérieur de l’éducation.
Article 23
Le Conseil national de l’enseignement supérieur et de la recherche statue en appel et en premier ressort sur les décisions disciplinaires prises par les instances universitaires compétentes à l’égard des enseignants-chercheurs, enseignants et usagers. Il exerce, à leur égard, les compétences définies par la loi du 17 juillet 1908 sur le relèvement des interdictions, exclusions ou suspensions prononcées par les juridictions disciplinaires de l’éducation nationale.
Le Conseil national de l’enseignement supérieur et de la recherche statuant en matière disciplinaire comprend des représentants des enseignants-chercheurs et des représentants des usagers. Lorsqu’il statue à l’égard d’enseignants, la formation compétente ne comprend que des enseignants-chercheurs d’un rang égal ou supérieur à celui de la personne déférée devant elle. La composition, les modalités de désignation des membres des formations compétentes à l’égard des enseignants et des usagers et leur fonctionnement sont fixés par décret en Conseil d’État.
Article 24
La composition et les attributions du conseil de l’éducation nationale institué dans chaque académie par l’article 12 de la loi n° 83-663 du 22 juillet 1983 complétant la loi n° 83-8 du 7 janvier 1983 relative à la répartition des compétences entre les communes, les départements, les régions et l’État, sont étendues à l’enseignement supérieur, sous réserve des dispositions du titre premier de la loi n° 85-2569 du 31 décembre 1985, relative à la composition et aux attributions des conseils de l’éducation nationale siégeant en formation contentieuse et disciplinaire et modifiant les lois n° 46-1084 du 18 mai 1946 et n° 64-1325 du 26 décembre 1964 relatives au Conseil supérieur de l’éducation nationale.
Lorsque les questions soumises aux délibérations des conseils relèvent de l’enseignement supérieur, le recteur, chancelier des universités, est rapporteur.
En ce qui concerne l’Île-de-France, il est institué un seul conseil académique pour les trois académies concernées.
Un décret en Conseil d’État fixe les modalités d’application du présent article.
Depuis 1989, le Conseil est présidé par le ministre chargé de l'Éducation nationale ou son représentant. Il est composé des représentants des enseignants, des enseignants-chercheurs, des autres personnels, des parents d'élève, des lycées, des étudiants, des collectivités territoriales et d'associations.
Dans sa formation plénière, le Conseil supérieur de l'éducation est composé de quatre-vingt-dix-sept membres titulaires, et de leurs suppléants, représentant :
les personnels : enseignants, enseignants-chercheurs, personnel d'orientation, d'éducation, de direction et d'inspection, personnels administratifs, techniques, ouvriers et de service.
les usagers : parents d'élèves, étudiants, lycéens.
les partenaires de l'État dans l'action éducatrice : collectivités territoriales, associations périscolaires et familiales, grands intérêts éducatifs, économiques, sociaux et culturels.
Leur mandat est de trois ans, à l'exception de celui des représentants des lycéens qui siègent durant deux années.
Le Conseil supérieur de l'éducation est également composé dans sa formation restreinte d'une section permanente et de commissions spécialisées. La section permanente comprend quarante-neuf membres titulaires, et leurs suppléants, élus par les membres de la formation plénière, dont ils sont une émanation.
Trois commissions spécialisées (écoles, collèges, lycées) ont pour rôle de préparer les avis du Conseil sur les textes concernant les programmes, les horaires et l'organisation des enseignements. Elles sont présidées par le directeur de l'administration centrale compétent pour le niveau d'enseignement correspondant, ou son représentant, et ses membres sont élus au sein du CSE.
Dans sa formation contentieuse et disciplinaire, le Conseil supérieur de l'éducation comprend dix-huit conseillers titulaires, et leurs suppléants, élus par les représentants au Conseil des enseignants, des enseignants-chercheurs et des établissements d'enseignement privés.
La « loi Jospin » du 10 juillet 1989 (loi n°89-426, article 22) regroupe le Conseil supérieur de l'éducation nationale et le conseil de l'enseignement général et technique sous le nom de Conseil supérieur de l'éducation. Ce conseil dans sa nouvelle configuration exerce donc les attributions antérieurement dévolues au Conseil supérieur de l'éducation nationale (CSEN) et au Conseil de l'enseignement général et technique (CEGT).
Organe consultatif, il est consulté sur tous les textes législatifs et réglementaires qui régissent l'éducation. Il se prononce ainsi sur les statuts des personnels, les programmes scolaires, les examens et les diplômes. Il donne également des avis sur les textes concernant l'enseignement privé.
En outre, le Conseil supérieur de l'éducation constitue une juridiction administrative spécialisée placé auprès du ministre de l'Éducation nationale. Il statue en appel et en dernier ressort sur :
les jugements rendus en matière de contentieux et de discipline par les conseils académiques de l'éducation nationale (dans le cadre d'une opposition à l'ouverture d'une école privée ou d'une interdiction d'enseigner prononcée à l'égard d'un instituteur),
les décisions prises par la commission des titres d'ingénieurs relatives aux écoles privées légalement ouvertes qui demandent à délivrer leurs diplôme d'ingénieur.
