France. Commission nationale de contrôle de la campagne en vue de l’élection du président de la République (1964-....)
La Commission nationale de contrôle (CNCCEP) est composée de trois membres de droit - le vice-président du Conseil d’État, président de la commission, le premier président de la Cour de cassation et le premier président de la Cour des comptes - et de quatre membres cooptés, dont deux suppléants. Pour l’aider dans ses missions, des rapporteurs sont nommés parmi les membres du Conseil d’État, de la Cour de cassation ou de la Cour des comptes. Ils ont notamment pour mission de vérifier que le matériel de propagande électorale des candidats est conforme au code électoral, et font ensuite un rapport pour les membres de la CNCCEP. De par sa composition, la Commission se veut impartiale et indépendante. La Commission siège habituellement dans les locaux du Conseil d’État. La campagne de 2002 fait néanmoins exception : si les séances avaient lieu en salle de la section des Finances au Palais-Royal, le secrétariat était installé dans les locaux de la Commission de régulation de l'électricité à Paris.
La mission de contrôle de la CNCCEP ne s’exerce pas par des sanctions. Selon les termes de Renaud Denoix de Saint Marc, vice-président du Conseil d’État entre 1995 et 2006, dans son discours lors de la séance d'installation en 1988, elle exerce une « magistrature morale », passant surtout par des échanges avec les candidats et leurs mandataires. Si cela s’avère nécessaire, la Commission peut intervenir auprès des autorités compétentes pour les avertir d'une irrégularité dans la campagne. Par exemple, si un média annonce les résultats avant la fermeture des bureaux de vote, il risque une amende de 75 000 euros. La CNCCEP ne condamne pas elle-même le média fautif, mais transmet si nécessaire l'information au CSA. En 2002, lorsque cette situation s'était présentée, la Commission avait simplement envoyé des courriers aux médias concernés.
La CNCCEP se réunit en séances : le calendrier prévoit en général une séance chaque semaine. À la fin de sa période de fonctionnement, la CNCCEP rédige un rapport, publié au Journal officiel de la République française, récapitulant ses actions et le déroulé de la campagne. C'est aussi l'occasion pour elle de faire des préconisations pour l'organisation des futures campagnes électorales.
La Commission nationale est aidée dans son action par des commissions locales de contrôle (CLC), régies par les articles R. 32 à R. 35 du code électoral. Relais départementaux de l’instance nationale, elles ont notamment pour mission de veiller au respect des règles en matière d'affichage électoral sur les panneaux officiels. De plus, ce sont les CLC qui sont chargées de la mise sous pli et de l’envoi des déclarations des candidats à l’ensemble des électeurs du département.
Ces CLC sont composées de 3 membres :
- un président, magistrat désigné par le premier président de la cour d'appel
- un fonctionnaire désigné par le préfet
- un représentant de l'opérateur chargé de l'envoi des déclarations et des bulletins de vote (la Poste ou une entreprise privée)
Le préfet désigne en outre un fonctionnaire chargé du secrétariat. Le siège de la CLC est choisi par son président, en accord avec le préfet. Les candidats ou leurs représentants locaux peuvent prendre part aux réunions de la CLC, leur avis n’ayant qu’une valeur consultative.
Des représentants ou délégués de la CNCCEP sont envoyés dans les départements et territoires d'outre-mer. Leur rôle n’est pas de participer à la CLC, mais de suivre localement le déroulement de la campagne. Ces représentants peuvent être choisis conjointement avec le Conseil constitutionnel, et ainsi veiller à la conformité des opérations électorales.
La loi n° 62-1292 du 6 novembre 1962 relative à l’élection du président de la République au suffrage universel dispose, dans son article 3-IV, que “tous les candidats bénéficient de la part de l’État des mêmes facilités pour la campagne en vue de l’élection présidentielle”. C’est afin de veiller au respect de ces dispositions à valeur organique que la Commission nationale de contrôle de la campagne en vue de l’élection du président de la République (CNCCEP) est instituée par l’article 10 du décret n° 64-231, datant du 14 mars 1964, portant application de la loi de 1962. Ayant connu d'infimes modifications depuis 1964, ce décret est abrogé et remplacé par le décret n° 2001-213 du 8 mars 2001, portant application de la loi n° 62-1292. Depuis, au cours de l'année précédant chaque élection, un décret modifie ou précise l'organisation du scrutin à venir. Les modifications les plus importantes concernant la Commission sont dues aux décrets n° 88-22 du 6 janvier 1988 et n° 94-672 du 8 août 1994, confiant successivement le contrôle de la campagne audiovisuelle à la Commission nationale de la communication et des libertés (CNCL), puis au Conseil supérieur de l'audiovisuel (CSA). Malgré ce transfert de compétence, la CNCCEP reste chargée de veiller à l’égalité des candidats, notamment en travaillant en collaboration avec les instances chargées du contrôle de l’audiovisuel. La Commission a pour fonction principale de vérifier le matériel de propagande électorale constitué des affiches et professions de foi des candidats, qu'elle doit avoir validée avant toute diffusion. Cela inclut aussi le contrôle des traductions proposées en Polynésie, en Alsace et en Moselle, le texte des déclarations et des affiches devant être uniforme sur l'ensemble du territoire. Enfin, depuis le décret n° 2001-213 du 8 mars 2001, la Commission nationale de contrôle doit transmettre au Conseil constitutionnel toute irrégularité pouvant influer sur les comptes de campagne.
La Commission doit être installée au plus tard 48h avant le début de la campagne officielle. Son activité prend fin le soir du dernier jour de scrutin. Les dates d'activité de la Commission lors des campagnes successives sont les suivantes :
1965 : du 29 octobre au 19 décembre ;
1969 : du mois d'avril au 15 juin ;
1974 : du 9 avril au 19 mai ;
1981 : du 19 mars au 10 mai ;
1988 : du 17 mars au 8 mai ;
1995 : du 6 mars au 7 mai ;
2002 : du 18 mars au 5 mai ;
2007 : du 23 février au 2 mai ;
2012 : du 25 février au 6 mai ;
2017 : du 26 février au 7 mai.
